Three deposit myths that often catch home buyers out 👀…

MYTH 1: The term ‘deposit’ always means the same thing.
REALITY: Depending on context, the term can refer to the upfront amount payable, or your overall equity or contribution towards the purchase price.

MYTH 2: I can use my KiwiSaver at short notice.
REALITY: KiwiSaver withdrawals must be applied for well in advance – often at least two weeks before the funds are needed.

MYTH 3: The deposit from selling my home is immediately available.
REALITY: Deposits from a property sale are typically held in a real estate agent’s trust account for at least 10 working days

Alex is thrilled to welcome Evanna as a Senior Solicitor to the Harkness Henry Employment Law team. Before joining Harkness Henry, Evanna practised employment law for four and a half years, including a period for a national firm. Prior to this she worked as a criminal prosecutor.

Earlier this week Devony and Isabel attended the Pink Ribbon Breakfast that was hosted by the WILA - University of Waikato’s Women In Law Association 🩷.

Thinking about a prenup? 👀

There’s a lot of misinformation out there. We’ve busted three common myths and shared what the law in New Zealand actually says. Because good planning starts with good information.

MYTH 1: Prenups are only for people who are getting married.
REALITY: De facto and other long term committed relationships can be subject to the Property (Relationships) Act too and a prenup can apply to all of them.

MYTH 2: Prenups are unfair and only benefit one person.
REALITY: For a prenup to be binding, it must be fair and reasonable to both parties. Agreements can be overturned if they cause ‘serious injustice’.

MYTH 3: Once a prenup is signed, it never needs changing.
REALITY: Life changes and your agreement should too. So prenups should be reviewed and updated over time to remain effective.
