I'm scared to tell you this, but you need to know that your parents won't be around forever.

While estate planning, your parents can often be the first choice for guardians, attorneys or trustees if the unexpected were to happen to you. However, as they age they may no longer be able to step into your shoes, and you need to consider a Plan C.

If your circumstances have changed over the years, then your will might need updating so that it still reflects your wishes. When you sign a new updated will, it revokes your previous will. You should review your will (or get a will) when any of these big life events happen:

- You have children
- You buy a house
- You enter into a relationship
- You end a relationship

Otherwise, it's a good idea to have a look at your will every few years.

If a lawyer has helped you prepare a will, then they will usually keep your original will for safekeeping.

There is no official registry of wills in New Zealand, so it's important that you let your loved ones know where your original will is kept.

You should be given a copy of your will which will indicate where the original will is being held.

Peace of mind for parents.

I've been signing a lot of wills and enduring powers of attorneys with families this week, which is the last step in the estate planning process.

So happy for these parents who can smuggly go into the next few years without this important task on their to-do list! Even more pleased that if the worst were to happen, their instructions are recorded and the process for their loved ones will be kinder.

To be valid, your will must:

✒️Be in writing,
✒️Made by you while you are mentally capable and not being coerced,
✒️Signed at the end of the document by you and two witnesses, with all three of you being present to see each other sign, and
✒️Intended by you to take effect as a will

However, if your will doesn't meet all of these requirements then a court may still declare it a valid will in certain circumstances.

Sometimes people assume that the people they write down in their will can make decisions on their behalf if they lose capacity. However, your will doesn't get pulled out unless you've passed away. Enduring Powers of Attorney are the documents which appoint attorneys to make decisions on your behalf while your still alive.

It's completely understandable if you don't have a full set of estate planning documents, finding the time and money to get everything in order can be tricky. But if you're ready, then feel free to get in touch to find out more.

There are good reasons why you don't have perfectly up-to-date estate planning documents:

1️⃣ You know wills and enduring powers of attorney are important but they don't seem as urgent as the million other household tasks.
2️⃣ You don't have a schedule which allows you both to drive kid-free into the city to see a lawyer at 11am on a Tuesday.
3️⃣ You have know idea how much all of this costs.

However, if you're sick of having this on your to-do list then I can help by:

2️⃣ Being flexible with after-hours and mobile meetings

Couples often assume that if one person loses mental capacity, the other would be able to step in and act on their behalf.

However, someone can only make decisions for you if you've appointed them in an Enduring Power of Attorney document while you were still mentally capable. Otherwise, they're applying to court to be appointed your welfare guardian and/or property manager, and they really don't need the added stress and cost of that.

People usually sort their Enduring Powers of Attorney at the same time as their Wills, and there are two types - one for property, and the other for your personal care and welfare. If you want to know more, feel free to message me.
