After weeks (or months!) of house hunting, inspections, finance applications, and paperwork, settlement day is finally here. But what actually happens?

Settlement day is the day ownership of the property transfers from the seller to you.

Here is what typically happens behind the scenes:

✅ Your lawyer receives your mortgage funds from the bank and any remaining funds required from you.

✅ Your lawyer transfers the purchase money to the seller's lawyer.

✅ Once the funds have been received, the property ownership is transferred into your name.

✅ The seller's lawyer authorises the release of the keys.

✅ Your real estate agent contacts you to let you know your keys are ready to collect!

🎉 Congratulations, you are officially a homeowner!

A few important things to remember:

💰 Ensure any funds you need to contribute have been paid to your lawyer in advance.

📞 Be available on settlement day in case your lawyer needs to contact you.

🏠 A pre-settlement inspection has been carried out before settlement to ensure the property is in the agreed condition.

One question we are often asked is: "What time will settlement happen?"

The honest answer is that we cannot say with certainty. The settlement process involves a number of parties working behind the scenes and while everyone works hard to complete settlement as early as possible, the timing can vary from one transaction to the next.

Settlement day can feel a little nerve-wracking, but it is also one of the most exciting milestones in the home-buying journey.

There is no shortage of advice when you are buying your first home, but not everything you hear is true! Let's separate some common myths from the facts.

❌ MYTH: I don't need a lawyer until my offer is accepted.

✅ FACT: Speak with a lawyer before making an offer so you understand the process and have the agreement reviewed before signing.

❌ MYTH: If the bank has pre-approved me, I'm guaranteed finance.
✅ FACT: Pre-approval is a great start, but final approval is usually subject to the bank being satisfied with the property and any remaining lending conditions.

❌ MYTH: A house that looks good must be in good condition.
✅ FACT: Cosmetic appearance do not always reveal underlying issues. Building inspections can help identify potential concerns before you commit.

❌ MYTH: My KiwiSaver can pay for all my home-buying costs.
✅ FACT: KiwiSaver withdrawals go towards the purchase price of the property and cannot be used for costs such as legal fees, building inspections, moving expenses, or insurance.

❌ MYTH: Once I find a house I love, I should sign immediately.
✅ FACT: Taking the time to obtain legal advice and complete your due diligence can help you make an informed decision and avoid costly surprises.

Do not rely solely on advice from friends, family, or social media. Every property purchase is different, and professional advice can help ensure you are making the right decisions for your situation.

You have probably heard of real estate agents who work with sellers, but did you know there are also professionals who can help buyers?

A buyer's agent is someone who works on behalf of the purchaser to help find, evaluate, and negotiate the purchase of a property.

A buyer's agent may be able to:

✅ Search for properties that meet your criteria
✅ Research property values and local market conditions
✅ Arrange and attend property inspections
✅ Negotiate with sellers and real estate agents on your behalf
✅ Help take some of the stress out of the home-buying process

For first home buyers, a buyer's agent can provide guidance and support, particularly if you are unfamiliar with the property market or struggling to find the right home.

If you are considering using a buyer's agent, make sure you understand their services, fees, and how they will work with the other professionals assisting you, such as your lawyer and mortgage broker.

For many first home buyers, their KiwiSaver savings can play a significant role in helping them achieve home ownership.

If you have been contributing to KiwiSaver for at least three years, plan on living in the property and meet the eligibility criteria, you may be able to withdraw most of your KiwiSaver balance to put towards the purchase of your first home.

Before you start house hunting, here are a few things to keep in mind:

✅ Check your eligibility early

✅ Contact your KiwiSaver provider to understand the withdrawal process

✅ Allow plenty of time, as withdrawal applications can take several weeks to be processed

✅ Make sure your solicitor is involved early, as they will typically need to witness documents and help coordinate the withdrawal

One of the most common issues we see is buyers leaving their KiwiSaver application until the last minute. Starting the process early can help avoid unnecessary stress and ensure funds are available when needed.

Saving a deposit is a huge achievement, but it is important to remember that buying your first home involves more than just the purchase price.

Before you make an offer, take some time to budget for the additional costs that can come with purchasing a property, including:

✅ Legal fees
✅ Building inspection reports
✅ LIM reports
✅ Valuation costs (if required by your lender)
✅ Moving expenses
✅ Insurance premiums
✅ Rates and utility connections

These costs can add up quickly, and planning for them early can help avoid unnecessary stress during the buying process.

A realistic budget will not only help you get into your first home, it also helps ensure you can comfortably enjoy home ownership once you've got the keys in hand.

💡 First Home Buyer Tip: Keep a contingency fund aside for unexpected expenses. It is better to have it and not need it than need it and not have it.

Short answer: Yes, it is a good idea!

Many first home buyers do not realise that once an Agreement for Sale and Purchase is signed, it becomes a legally binding contract. That is why obtaining legal advice before making an offer can be one of the smartest steps you take in the home-buying process.

A lawyer can help you:

✅ Review the Agreement for Sale and Purchase before you sign

✅ Make sure appropriate conditions are included, such as finance, LIM, or building inspection conditions

✅ Explain your rights and obligations in plain English

✅ Identify any potential risks or unusual clauses

✅ Give you confidence before committing to one of the biggest purchases you will ever make

While it may be tempting to move quickly when you have found "the one", taking a little time to get legal advice can help prevent costly surprises down the track.
