Big Win for Kiwi Families: Probate Threshold Jumps to $40 K 💡

As of 24 September 2025, the NZ Government has finally lifted the probate threshold from $15,000 to $40,000 — a small policy shift with a big impact.

For years, even modest estates — often just KiwiSaver, a car and a bit of savings — were forced through the High Court, draining families of time and money at the worst possible moment.

Now, if your estate is worth $40 K or less and you have a valid will, your family can skip the probate process entirely. That’s real relief when it matters most.

But here’s the catch
If you don’t have a will, probate still applies — even if your estate’s only $10 K. So yes, getting your will done (or updated) is critical.

Is the Supreme Court overreaching its role?

A new report from think-tank The NZ Initiative says so, with recent Supreme Court decisions raising alarm in both the legal and political sectors.

20 years on from its predecessor, the London-based Privy Council, the Supreme Court is the highest court of appeal in the land.

The report says the court is straying into Parliament’s domain and is granting itself the power to rewrite legislation it does not like. It says Parliament needs to reassert its sovereignty and to stop the current drift towards “judicial supremacy”.

One of the suggestions proposed from the report is imposing a term limit of 5 - 7 years for judges at the Supreme Court before returning to the Court of Appeal. At the moment judges serve open-ended limits.
