Has your child turned 18 and about to fly the nest? You need to have a serious conversation with them.

Once your child is 18 you are no longer their guardian. If your child has an accident or is hospitalised and incapacitated, you are unable to make decisions about their personal care and welfare. This requires you to get a court-appointed guardian, this process is timely, expensive, and extremely stressful. This can be avoided by your child appointing an Enduring Power of Attorney ("EPA"). An EPA allows your child to nominate you or an appropriate person to be their attorney in the event of the unforeseen. There are two types of EPAs; one in relation to personal care and welfare and another in relation to property. For an EPA to be correctly executed, a Lawyer or Legal Executive needs to advise the donor (the person who is creating an EPA) on the appointment process and what decisions their attorney can and cannot make and sign the document.
