As family lawyers what do we assume clients want from us? What compels them to rave to others about what a great lawyer we are? Great legal advice? Achieving "a win"? Their lawyer's ruthless, "compete to win", adversarial approach?

When we looked into what clients said was important to them about working with a lawyer, we discovered that PROCESS - the client's experience of the resolution of their matter - shone through brightly.

Did the client feel heard throughout? Did the lawyer take the time to really understand what was important to the client and their family? Did the process allow the client to have autonomy around the operation of the resolution process and the decisions made for their future? Did the process focus on creating solutions that meet the needs of the participants and their children? Did the process harm their parenting relationship or support it? Was the process RESPECTFUL?

The Collaborative Law Process ticks lots of the "process" wishlist items for clients with a great side effect being that, in turn, they appreciate their lawyers for guiding them through it (and tell their friends!).

Are we entering a new "era of divorce"?

It's not just Justin Trudeau and Ariana Grande who are moving on from their marriages - predictions are that increasing numbers of us will be!

Emerging from lockdown, increased financial pressures, anxieties, the cost of living crisis and a change in societal trends prioritising individual happiness and personal growth, are all factors that have been pointed to for explaining an uptick in divorce, or the ending of de facto relationships.

Although family lawyers are busier than ever, there aren't any statistics available to check whether this prediction is playing out in New Zealand but watch this space!
