The new Skilled Migrant Category rules are now in effect, and migrants working as chefs, restaurant and cafe managers, hotel and motel managers, and retail managers must be prepared. INZ will now closely assess whether your daily duties truly match ANZSCO - not just your job title.

https://awaaz.co.nz/new-zealand/new-skilled-migrant-rules-are-here-for-chefs-and-managers-the-job-title-may-not-be-enough.html

The burden of proof rests entirely on the applicant to demonstrate their role is a "substantial match" to the ANZSCO description.

🇳🇿 Navigating the New Residence Rules: Real Cases, Real Results!
Following the major New Zealand immigration rule changes on August 24th, we’ve received a large influx of inquiries from migrants wondering how the new instructions affect their eligibility—especially regarding how skilled work experience is counted.
At Contact New Zealand, we don't just talk about policy; we actively work across a wide spectrum of applications every single week.
Current Residence Cases We Are Managing Right Now:
To give you an idea of how diverse and active the immigration landscape is post-August 24th, our current workload includes:
Straight to Residence (Doctors): Assisting an overseas-registered doctor who completed their local registration and is now lodging their direct residence application.
6-Point SMC Pathway (Retail Manager): Managing an application for a store manager leading a franchised furniture retail outlet.
6-Point SMC Pathway (Early Childhood Teacher): Securing points combining skilled employment and a Master’s degree.
Trades & Technical Roles (Motor Mechanic): Helping a mechanic leverage an overseas qualification for points alongside their skilled work experience.
Hospitality Management (Venue Manager): Managing a complex regional venue and bar management application.
Why Experience Matters When Instructions Change
When immigration rules shift, minor misinterpretations of instructions, wage thresholds, or work-experience lookback windows can lead to costly delays or declines.
Working with an advisor who handles a wide variety of sectors means we know precisely how Immigration New Zealand interprets these rules—and how to build a winning strategy for your specific situation.

🚨 Critical Updates: New August 2026 Residence Rules & Processing Priorities
New Zealand's updated residence instructions officially took effect on August 24, 2026, bringing major changes to application requirements and how files are queued by Immigration New Zealand (INZ).
If you are planning to lodge your residence application, here are two vital updates you need to know:
1. Are Birth Certificates Mandatory at Submission?
According to the official instructions, birth certificates are not a mandatory lodgment requirement when submitting your residence application online.
The Catch: While it may not stop initial lodgment, experience shows that some immigration officers frequently request birth certificates during processing.
Our Expert Advice: If you have your birth certificates ready, upload them upfront with your initial application to prevent unnecessary officer queries and processing delays down the track.
2. Shift in INZ Processing Priorities
Immigration New Zealand has updated the order in which residence applications are reviewed, prioritising specific pathways over others:
Top Priority: INZ is now fast-tracking Straight to Residence applications and the Skilled Migrant Category (SMC) Points-Based Pathway.
Lower Queue Order: Applications submitted under newer pathways—such as the Trades and Technician Pathway or the Skilled Work Experience Pathway—will be picked up after the prioritised categories.
If you are aiming for a faster decision, understanding where your application lands in the queue is crucial.
Don't Guess Your Eligibility. Get Proactive.
Navigating the post-August 2026 residence landscape requires strategic planning. Whether you want to ensure your document checklist is airtight or check which pathway gives you the processing speed advantage, let's look at your specific case.

⚠️ The Costly Partnership Mistake That Can Jeopardise Your NZ Residency!
If you are currently on a temporary partnership-based visa and planning to lodge your residence application, there is a critical mistake that many applicants make every single year.
Submitting a residence application alone does not automatically grant you an interim visa.
If your current temporary work visa is expiring, simply filing for residency will not keep you lawfully in New Zealand.
What Happens If You Make This Mistake?
Loss of Lawful Status: If your current temporary visa expires before another temporary visa is lodged, you become unlawful.
The Residence Freeze: Immigration New Zealand will automatically pause the processing of your residence application until you regain lawful status.
Unnecessary Stress & Delays: Fixing an unlawful status complicates your entire immigration journey and delays your pathway to settled life.
The Golden Rule for Partnership Visas:
If your temporary visa is expiring while you wait for residency, you must submit a separate partnership-based temporary visa application to remain lawfully in New Zealand and trigger your interim visa rights.
Don't Gamble with Your Legal Status
Navigating partnership requirements, temporary extensions, and residence applications requires precision and timing. Don't leave your lawful status to chance.

👨‍👩‍👧‍👦 Big Changes to the Parent Resident Visa: What You Need to Know!
Are your parents’ Expressions of Interest (EOI) sitting in the pool? Immigration New Zealand has just announced a massive shift in how parent residence applications will be selected.
If you are waiting to bring your parents to New Zealand, understanding this new system is critical.
What is Changing?
Starting later this year, the random ballot system is shifting to a new hybrid model:
90% Chronological Queue: The vast majority of EOIs will now be selected in date order (first-come, first-served based on when they entered the pool).
10% Ballot: A small portion will still be selected via ballot to give newer applicants a chance.
Annual Cap Remains: Immigration New Zealand only approves up to 2,500 Parent Resident Visas each year. With roughly 7,700 people currently waiting in the pool, the math means patience and planning are more important than ever.
What This Means for You:
If you applied long ago: If your parents' EOI has been in the pool for 18 to 24+ months, you have reason to celebrate. You are much closer to receiving an Invitation to Apply (ITA) under the chronological queue.
If you applied recently: If your EOI was submitted recently, expect a longer wait—potentially up to 2 to 3 years—before reaching the front of the queue.
No More 2-Year Expiry Stress: EOIs will no longer automatically expire after two years, provided you keep your details updated and confirm your ongoing interest.
Don't Leave Your Family's Future to Chance
Navigating immigration policy changes requires a clear, long-term strategy. You must ensure your sponsor income thresholds continue to align with INZ requirements while you wait in the queue.

🛑 A Single Mistake Can Cost You Your NZ Visa: Take Conditions Seriously!
Many migrants don't realise that a small, impulsive mistake can completely jeopardise years of hard work and thousands of dollars invested in a New Zealand education.
We recently handled a tense case for a young client who got caught doing stunts in his car on a beach, resulting in a criminal case. When he applied for his post-study work visa, Immigration New Zealand naturally raised serious concerns regarding his character.
Without intervention, his future in New Zealand was hanging by a thread.
How We Turned It Around:
Addressed the Issue Head-On: We didn't hide the mistake; we confronted it directly with Immigration.
Provided Context: We explained that he is a young student making his first mistake, showing remorse and highlighting that this uncharacteristic lapse in judgment would never happen again.
Saved His Pathway: Because we navigated the character assessment properly, Immigration approved his post-study work visa just a few days ago!
For him, this wasn’t just a visa win—it saved his entire investment in his New Zealand education and gave him the chance to gain vital local work experience.
A Word of Advice to All Migrants:
Don't make fun of your visa conditions, and don't take your legal responsibilities lightly in New Zealand. A minor brush with the law can quickly turn into a major barrier to your residency and career goals.
Take your visa conditions seriously. If you ever find yourself facing unexpected character or compliance hurdles, make sure you get professional guidance before it's too late.

🛑 Hospitality Job Check Declined? Why a "Simple Response" Isn’t Enough.
If you run a hospitality business in regional New Zealand and recently had a Job Check declined or questioned, you know how frustrating Immigration New Zealand's pushbacks can be.
Recently, we managed a case for a regional hospitality client who applied for a Bar Manager position. INZ raised a major concern: “When you already have a Restaurant Manager, why do you need a Bar Manager?”
A standard, generic response would have led to a refusal. Instead, we dug deep into the business:
We analysed the venue's sales records and the wet-and-dry sales split, proving that bar revenue nearly equaled restaurant revenue.
We built a robust operational argument demonstrating why two distinct management roles were essential for business volume.
We researched past IPT (Immigration and Protection Tribunal) residence decisions and integrated relevant legal precedents into our submission.
The result? The concerns were overcome, and the business secured the outcome it needed.
Don’t Leave Your Business Growth to Chance
When INZ challenges your staffing needs, sending a quick reply won't cut it. You need an advisor who takes the time to thoroughly understand your business model, ask the right questions, and fight for your commercial interests.
If you are an accredited employer in the hospitality sector looking for a dependable, strategic Licensed Immigration Advisor, let’s talk.
