The Government has announced reforms to the Accredited Employer Work Visa (AEWV) scheme, a new seasonal work pathway and work rights for more Interim Visa holders.

The changes will be rolled out during 2025 and include removing wage thresholds, reducing work experience requirements and streamlining the Job Check process.

Work Visa Reforms Announced

The Government announced significant reforms to the Accredited Employer Work Visa (AEWV) scheme, a new seasonal work pathway, and expanded work rights for Interim Visa holders, to be rolled out throughout 2025.

Key Changes:

1. From 27 January 2025:
- Accredited employers no longer need to complete Employment NZ online modules or offer paid time for this.
- Construction businesses' NZ workforce requirement reduces from 35% to 15%.

2. From March 2025:
- Wage thresholds for AEWV roles will be removed (market rate still applies).
- Work experience requirement reduces to 2 years (currently 3 years).
- Job Check evidence of Work and Income engagement replaced with a declaration of advertising and interviews.
- Lower-skilled AEWV duration increases to 3 years (currently 2 years).
- Migrants must earn NZ$55,844 annually to bring children.

3. From April 2025:
- Some work and student visa holders applying for AEWV can work on an Interim Visa while their application is processed.

4. Mid-2025:
- A new, streamlined Job Check process will be introduced to reduce delays for low-risk employers.

5. November 2025:
- Two new seasonal worker pathways:
- 3-year multi-entry visa for experienced workers.
- 7-month single-entry visa for lesser-skilled workers.

The Australian and New Zealand Standard Classification of Occupations (ANZSCO), currently used by Immigration New Zealand (INZ), is set to be replaced by a new, country-specific system called the National Occupation List (NOL). This change, effective from November 20, 2024, reflects the need for a more tailored classification system due to significant differences in labor markets between the two countries. Some roles skill level may move up from level 4 to level 3 which will allow migrants to support partners and dependents.

INZ will continue to use ANZSCO during the transition to the NOL, and further updates, including a confirmed switchover date, are expected in 2025. The NOL aims to better address New Zealand's unique labor market needs and streamline visa processes. Starting on December 2, 2024, partners of migrant workers can receive open work rights under the Partner of a Worker Work Visa, allowing them to work for any employer. This applies if their partner holds an Accredited Employer Work Visa and works in a higher-skilled role or a lower-skilled role on a pathway to residence. Eligible partners include those whose partners are:

- In ANZSCO Level 1-3 roles, earning at least $25.29 per hour.
- In ANZSCO Level 4-5 roles on the Green List, Transport, or Care Workforce Sector Agreements, earning the residence wage threshold.
- In ANZSCO Level 4-5 roles, earning at least 1.5 times the median wage.
- On an Essential Skills Work Visa, earning at least $25.29 per hour.

Current visa holders can apply to switch to open work rights on 2 December if their partner meets the new criteria.
