Immigration issues don’t always happen “over there”. Sometimes they hit closer to home than you’d expect.

Our immigration lawyer Andrew Nah joined The Panel with Wallace Chapman, alongside Nikki Bezzant and Ed McKnight, to discuss the concerning case of a New Zealander being held in a US ICE detention facility, and the wider confusion surrounding the US Green Card system.

Andrew highlighted a key issue: confusion around what needs to be declared. His advice is simple. When in doubt, declare everything. Even matters that seem minor, historic, or already dealt with can still raise flags if they are not disclosed.

He also pointed to increasingly strict border controls in countries like the US. Something that may not have been an issue in the past can suddenly become one under tighter scrutiny.

We see similar situations here in New Zealand. Travellers are sometimes stopped or detained at Auckland Airport due to visa conditions, character concerns, or discrepancies in their information, often when they believed everything was in order.

The takeaway is that immigration systems are complex and constantly evolving. Getting advice early can help you understand your obligations, avoid costly mistakes, and reduce the risk of issues at the border.
