The Ashbourne Fast‑track Decision is in — and it strikes a careful balance.

In its 21 April 2026 decision, the Ashbourne Expert Panel approved development where impacts could be managed, while firmly protecting highly productive land. Solar farms and a reduced residential subdivision were given the green light, but the retirement village was declined due to clear policy conflicts and viable alternatives elsewhere. The outcome is a timely reminder that fast‑track approval does not override the National Policy Statement for Highly Productive Land — and that early, rigorous site analysis is critical.

In our latest newsletter, we look at the High Court’s decision in Ngāti Kuku Hapū Trust v EPA, the first judicial review under the Fast-track Approvals Act 2024. The Court declined to pause the Stella Passage Development, emphasising the FTAA’s purpose of streamlined, timely decision-making while still affirming the right to judicial review.
