This is the letter that the State Secretary of Justice, Mrs. Ankie Broekers-Knol, sent to the Chairperson of the Dutch Parliament. In this letter, the State Secretary outlines her decision to tighten the current search year visa policy through requesting a university to be on at least 2 ranking lists of 2 different publishers (QS, Times Higher Education or Shanghai). This letter is dated 17 May 2021 (the day before yesterday).

With regard to the new search year policy, the State Secretary said that there would be no retroactive effect. The new policy will be published in one of the state gazettes. Before it gets published and enforced, the current laws apply. Also, on the basis of the Dutch legal principle 'eerbiedigende werking', the date of your application determines the laws that shall apply to your application. Should you have a degree from one of the 'borderline' universities (ie. universities that rank top 200 on only 1 ranking list), you should launch your application ASAP (in any case, before the enforcement of the new law). Even if you have not got your diploma validation (or even diploma) yet, we can help you launch your search year visa application with one of our embassies/consulates. The State Secretary of Justice sent a letter to the Dutch Parliament yesterday, in which she said that the Dutch Government have decided to tighten the search year visa policy soon. At this moment, one is eligible for the search year visa, if his/her university is among top 200 worldwide, in accordance with one of the general, faculty or subject ranking lists published by QS, Times Higher Education or Shanghai. In 2020, the IND found out that some applicants attempted to abuse the search year visa policy. A few dozen applicants applied for asylum after their arrival in the Netherlands. Therefore, the NL Government decide to require all future applicants to show that their university is among top 200 on at least 2 ranking lists published by 2 different publishers. Two different ranking lists of the same publisher will be perceived as 1 ranking list. As a result, graduates from less prestigious universities will no longer be eligible for the search year visa.
