I am giving an in person guest lecture to a small group of students at the Amare, and it is live streamed to the rest of the department. I will be speaking about Legal & Ethical Guidelines for Quantum Technology on Saturday Nov. 20 at 9:15-10:15 a.m. Phoenix, Arizona time (GMT-7) as part of the Quantum Technologies, Law, and Public Policy: A Global Perspective Conference. This two-day online event is hosted by the National Science Foundation (NSF) sponsored Center for Quantum Networks at the University of Arizona, and the University of Denver Sturm College of Law. Speakers include a cross-disciplinary line-up of quantum & law scholars from UC Berkeley School of Law, University of Toronto Faculty of Law, the University of Arizona, Sabanci University, Loyola Law School, Lund University, and Stanford Law School.

Besides explaining quantum physics and discussing regulation, the focus is also on developing countries and their challenge with the future of quantum technologies. Our managing partner Mauritz Kop (Stanford Law School) has the honor to guest-edit a Topical Collection for Digital Society, a new journal edited by Luciano Floridi (). Articles will be double blind peer reviewed. Accepted articles will be published by Springer Nature.

We especially welcome cross-disciplinary contributions that look beyond research silos and integrate law, economic theory, ethics, sociology, philosophy of science, quantum information science, and sustainable innovation policy, and that consider how to improve ELSPI stratagems for quantum technology. New Stanford tech policy research: “EU Artificial Intelligence Act: The European Approach to AI”. 😀😎

On 21 April 2021, the European Commission presented the Artificial Intelligence Act. This Stanford Law School contribution lists the main points of the proposed regulatory framework for AI.

The draft regulation seeks to codify the high standards of the EU trustworthy AI paradigm. It sets out core horizontal rules for the development, trade and use of AI-driven products, services and systems within the territory of the EU, that apply to all industries.

The EU AI Act introduces a sophisticated ‘product safety regime’ constructed around a set of 4 risk categories. It imposes requirements for market entrance and certification of High-Risk AI Systems through a mandatory CE-marking procedure. This pre-market conformity regime also applies to machine learning training, testing and validation datasets.

The AI Act draft combines a risk-based approach based on the pyramid of criticality, with a modern, layered enforcement mechanism. This means that as risk increases, stricter rules apply. Applications with an unacceptable risk are banned. Fines for violation of the rules can be up to 6% of global turnover for companies.

The EC aims to prevent the rules from stifling innovation and hindering the creation of a flourishing AI ecosystem in Europe, by introducing legal sandboxes that afford breathing room to AI developers.

The new European rules will forever change the way AI is formed. Pursuing trustworthy AI by design seems like a sensible strategy, wherever you are in the world.

Congrats to the European Commission for the birth of the Law of AI! This means our thoughts, those of so many other stakeholders, and CoE’s CAHAI, closely align.

It takes courage and creativity to be a pioneer in this novel field, forcing companies from the powerful US and China tech blocks to abide by EU standards before their AI & data driven products & services can obtain a CE-marking and enter the European 450 mln consumer markets. Regulating emerging technology is an ongoing effort, as society is in constant flux. Written in June 2020 as part of my ongoing Stanford University research, the article provides recommendations directly to the EC's DG Connect.

Data has become a primary resource that should not be enclosed, but used for the common good. We need not to think in terms of exclusive, private property on data but in terms of rights and freedoms to use.

There should be exceptions to (de facto, economic or legal) ownership claims on data that provide user rights and freedom to operate in the setting of AI model training. To ensure an efficiently functioning EU data-driven economy, a novel right to process data for machine learning purposes must be introduced to the field of AI & law. Such a right makes access, sharing and re-use of data possible, and helps to fulfil the European Strategy for Data’s desiderata.

The article draws inspiration from the works of canonical thinkers such as Locke, Marx, Kant & Hegel.

Quantum technologies are rapidly evolving from hypothetical ideas to commercial realities. As the world prepares for tangible applications, we should design solutions that can balance their transformational impact, and put controls in place that address identified risks & incentivise sustainable innovation.

Establishing a culturally sensitive legal-ethical framework for applied technologies can help to accomplish these goals. This can be built on rules and requirements for . We can enrich this prototype framework further by integrating ethical, legal & social issues ( ) associated with nanotechnology. The unique physical characteristics of quantum mechanics demand universal guiding of responsible, human-centered QT. To this end, the article proposes ten guiding principles for the development and application of QT.
