The Internet was meant to bring the world together; to make communications easier and more seamless...and it did, by bringing the world to everyone's fingertips through the WWW.

This huge advantage came with a fantastic disadvantage: an overwhelming rise in digital piracy.

A couple of weeks ago, Nollywood actor and producer Funke Akindele uploaded a video on her accounts, where she asked her fans NOT to record her latest cinematic release when they go view it at cinemas around Nigeria...all in a bid to curb piracy.

Omoni Oboli in a recent TV interview also bemoaned piracy, stating that it's eating deep into the profitability of their projects.

In the past it was easier to find pirated copies of copyrighted works and seize them with a view to destroying them. Today, it's not so easy. It's literally digital, made up of binaries; who exactly can you grab? How many digital copies can you destroy? These movies and books literally spread like wildfire, from one WhatsApp group to another, one telegram channel (the biggest suspect here) to multiple devices...and on and on.

It's almost as though digital piracy is invalidating protection. As an lawyer I find this very concerning, and although I can give numerous platforms their flowers in their trying to curb digital piracy, it seems we've only just scratched the surface and there's a whole lot yet to be done.

Section 852 (1) (d) of the Companies And Allied Matters Act, 2020 prohibits the of a , business name, limited partnernship or Limited liability partnership in if the intended name sought to be registered will violate or conflict with an existing .

Simply put, you can only register such a company, LP, LLP or business name in Nigeria with the consent of the trademark owner.

An example:

Mr. A owns the trademark "Montaz-Bank" in class 44 of the Nice Classification. You want to register the LLP, Montaz-Bank LLP. You'll have to first seek the consent of the trademark owner of "Montaz-Bank" before you register. If you don't, and even if you eventually register the name, the trademark owner of Montaz-Bank can petition the to deregister the name or change it to another.
