Today at the Court of Appeal, Port Harcourt Judicial Division, we secured judgment against the Rivers State Government on behalf of 97 staff members of Ignatius Ajuru University of Education (IAUOE), whose salaries were stopped in February 2016 following a directive issued by the Governor of Rivers State at the time.

On 13th June 2018, the National Industrial Court delivered judgment in favour of the staff, declaring that their employment was valid and subsisting; that the directive stopping their salaries was unlawful, null and void; and restraining the Governor and IAUOE from interfering with their employment.

However, the National Industrial Court declined to make an order compelling the defendants to pay the staff their outstanding salaries.

For over 10 years, these staff members endured hardship without salaries.

Today, that injustice was corrected.

The Court of Appeal dismissed the Government’s appeal against the judgment of the National Industrial Court and allowed our cross-appeal challenging the lower court’s refusal to order payment of the staff’s salaries.

The Court of Appeal accordingly ordered the Rivers State Government and IAUOE to pay the staff their salaries and emoluments from February 2016 until full compliance with the judgment.

Justice has been served. ⚖️

Read this before you say “I do.” Because in 2026, the distance between “happily ever after” and “property dispute in court” is shorter than the lifespan of your wedding champagne.

Here’s the Legal Ingredients List for statutory marriage in Nigeria as it involves two categories of requirements:

1. Substantive Requirements (Personal Eligibility)
• Both parties must be single (or legally divorced).
• Minimum age is 18 years.
• Consent must be freely given by both parties.
• Parties must not be closely related by blood.

2. Procedural Requirements (Legal Steps)
• Notice of Marriage filed at the registry.
• Publication of banns (public notice for 21 days).
• Issuance of certificate after no objections.
• Marriage ceremony conducted at a licensed registry or church.
• Signing of the marriage register in the presence of witnesses.

Why Statutory Marriage Matters:

Inheritance Rights: Statutory spouses are legally entitled to inherit without dispute.

Divorce Proceedings: Only statutory marriages can be dissolved under the Matrimonial Causes Act.

International Recognition: Statutory marriage certificates are valid for visa, immigration, and legal documentation abroad.

Property Division: Courts can enforce equitable sharing of assets.

Common Misconceptions

A church wedding without registration is not automatically a statutory marriage.

Paying bride price does not equal legal marriage under the Act.
