PART II: WHY DO LAWYERS RAISE OBJECTIONS IN A COURT ROOM?
As discussed earlier, objections opposes the testimony, evidence or manner where a witness or the other lawyer presents anything. Let's take a look at Preliminary Objection.
This happens in court and before the trial begins but this is done in writing and by way of Motion.
1. Lack of Jurisdiction: where the court that is handling the case doesn't have the legal power to do so.
2. Statute of Limitations: where the case is brought to court but the time has passed. This means that the law gave a particular deadline for such a case to be brought in court and it cannot be handled by any court if it is brought after that deadline.
3. Lack of Locus Standi: where the person instituting the action in court doesn't have the legal right to do so.
4. Improper service: where the other party was not properly notified that a case was brought against him in court in accordance with the legal requirements.
5. Res judicata: where the case has already been handled and a competent court decided on it.
A lawyer uses this objection to show that the case is defective and it would waste the court's time while the court can either dismiss the case or allow the case to continue to trial.
DO YOU THINK THIS KIND OF OBJECTION IS UNNECESSARY?
