Earlier today, our Principal Partner appeared with his Learned friends at the Supreme Court of Nigeria against Dangote Cement Plc. After critical sound legal reasoning with the eminent panel of 5 jurists, our application for leave to argue some Grounds of Appeal was granted and all our processes were deemed properly filed and served. The Appeal was adjourned to 14th day of February 2028 for hearing. Its really unfortunate how long matters drag at our Supreme Court. This Appeal started in 2019 at the Supreme Court and we got this date after 6years only for the Appeal to be further adjourned to 2028. There is indeed urgent need to create State/Regional Supreme Courts in Nigeria. This is discussion for another day anyways.
Be the above as it may, the facts of this case against Dangote is rather unfortunate and pathetic. Dangote Cement Truck in their usual characteristics had accident with our client vehicle and killed 2 of our clients who are breadwinners of their respectivefamilies. Dangote offered settlement of 6m and drafted agreement that we signed. Subsequently, they reneged from the Agreement they initiated and voluntarily entered into with us claiming it was a mistake. We commenced action against them in Court and got judgment. Instead of complying with the judgment, they proceeded on Appeals since 2018 and here we are still fighting for 7 years now. Both parties have spent more than the 6m they should have paid to settle this case since then. We hope to see to the end of this battle one day.
