*Lawyers to pay N1m to apply for SAN rank*

he Legal Practitioners’ Privileges Committee (LPPC) has opened applications for the 2023 award of the rank of Senior Advocate of Nigeria (SAN) with a N1million fee.
The LPPC, in a notice by its Secretary/Chief Registrar of the Supreme Court, Hajo Sarki Bello, said the application began on January 1, and closes on March 31, 2023.

The notice, seen by The Nation on Tuesday, stated that the invitation was in accordance with Section 5(2) of the Legal Practitioners Act, 2004 and Regulation 10 (1) (4) of the Guidelines for the Conferment of the Rank of SAN 2022.

It reads in part: “The Legal Practitioners’ Privileges Committee (the LPPC” or “the Committee”) hereby makes a formal call for applications preparatory to the award of the rank for the year 2023.

“Commencing with this year’s exercise, applications shall only be made online and prospective applicants are directed to visit www.lppconline.com to make their applications.”

It notified prospective applicants that each person “must pay a non-refundable processing fee of N1million only to any of the following accounts held in the name of the “Legal Practitioners Privileges Committee (SAN)”: Account Number:1014103141, at Zenith Bank PLC and Account No. 0213662834 at GTBank PLC.

“Upon conclusion of payment, an applicant should upload a copy of the evidence of payment on the application portal. The applicant will receive an email notification from the LPPC Secretariat confirming the applicant’s payment and clearing the applicant to proceed with the application process online.”

The LPPC warned further that Any submission made after the deadlines “shall be treated as a non-submission.”

ISSUE
POLICE - DUTY OF POLICE - Whether the duty of the police includes the settlement of civil dispute or debt collection

PRINCIPLE
"The duty of the Police as spelt out in Section 4 of the Police Act include prevention and detection of crime, the apprehension of offenders, the preservation of law and order, the protection of life and property and the due enforcement of all laws and regulations with which they are directly charged. I have scrutinized the provisions of the Section 4 of the Police Act and I am unable to decipher any provision empowering the Police to enforce contract or meddle into purely civil transactions between parties. The interference of the Police in purely civil matters is an abuse of the statutory powers of the Nigerian Police. I am not oblivious to the fact that the Police receive countless petitions daily alleging one crime or the other, however the Police is not a robot incapable of methodically sieving through the Petitions to determine if there is criminal element or not in each of the Petition before acting on same. It does not augur well for the society if the Police upon the instigation of a complainant acts outside its statutory defined functions by interfering in simple civil transactions between citizens. Simply put, it is neither the duty nor the power of the Police to serve as agents of any person, be it an individual or a corporate citizen or even agents of Government at either the Federal or State or Local Government level, to enforce commercial disputes, under any guise or pretext of investigating a crime in a purely civil dispute without any element of criminality. See Section 8(2) of the Administration of Criminal Justice Act 2015, wherein it is provided thus: "A suspect shall not be arrested merely for a civil wrong or breach of contract. This prevalent attitude of involving the Police in a purely civil transaction under the guise of commission of a crime has received scathing deprecations by the Supreme Court in a multitude of cases. COURT HAS NO POWER TO REMAND A SURETY IN PRISON FOR FAILURE TO PRODUCE THE ACCUSED IN COURT.

CRIMINAL LAW AND PROCEDURE - BAIL -
*_Whether a trial Court is empowered to remand a surety for failure to produce an accused person standing trial in a criminal offence_*

*Principles*
"In the instant appeal evaluating the facts at the trial Court, there was a contractual relationship between the trial Court and the Appellant wherein the Appellant was the surety to the Defendant (now a convict) to ensure his appearance in Court to face his trial at all times. And the Appellant as surety denotes that he was primarily liable for paying for another's debt or obligation whether primarily secondarily, conditionally or unconditionally. See the Blacks Law Dictionary, 9th Edition, 2009 on the meaning of "surety."? If I may ask, what is the criminal offence of the Appellant that warrants the trial judge to make an Order remanding the Appellant in Correctional Centre? I have perused the provisions of both the Administration of criminal Justice Act 2015, the Criminal Procedure Act and Criminal Procedure Code dealing with sureties, I am unable to lay my hands on any provision that empowers the Court to remand a surety for failure to produce a defendant, suspect or accused person standing trial in a criminal offence. The relationship between the surety and the Court is contractual and where the surety fails to produce the Defendant/suspect in Court for his trial, the Court will now evoke those bail conditions in accordance with the law before bond is forfeited. In otherwords, the Appellant, Senator Mohammed Ali Ndume was remanded in the correctional centre without a known offence in law. A close look at the provisions of Sections 165 and 179 of the ACJA, 2015, it does not empower the trial Court to remand the Appellant. A judicial officer must be circumspect in the application of his judicial powers and such exercise must be done judicially and judiciously in accordance with the law. Thus, therefore the order remanding the Appellant in the correctional centre by the trial Court, the trial Court has crossed the red lines of his Oath of office and therefore null, void and unconstitutional." Per DANLAMI ZAMA SENCHI, JCA (Pp 32 - 34 Paras D - A).
