In this judgement, the court reiterated the principle that although an employer is not under any obligation to disclose the reason for terminating the employment of an employee, where a reason is provided, the employer assumes the burden of proving the veracity of the reason.

The court further restated the principle that where an employee is accused of misconduct, the employee must be afforded an opportunity of fair hearing, failure to do so renders the termination wrongful.

This judgment in Polaris Bank v Wole Ajimisinmi, reinforces the enduring principle that parties are bound by the terms of contracts voluntarily entered into and that financial obligations cannot be avoided on the basis of speculative or unsubstantiated claims.

The decision also reiterates the settled position of the law that loan and mortgage transactions retain their independent legal character notwithstanding the existence or termination of an employment relationship.

Ultimately, the judgment underscores the judiciary’s continued commitment to upholding contractual sanctity, commercial certainty, and accountability in financial transactions.
