QUESTIONS AND ANSWERS

1️⃣ Question: Can a landlord evict a tenant without going to court if the rent is overdue?

Answer: No. In Nigeria, a landlord must follow the Landlord & Tenant Law and get a court order for eviction. Self-help evictions are illegal and can land the landlord in trouble.

2️⃣ Question: Are WhatsApp messages admissible as evidence in court?

Answer: Yes, if they can be authenticated and show the sender, recipient, date, and content clearly. Courts treat them as electronic evidence under the Evidence Act 2011.

3️⃣ Question: Can someone claim adverse possession of government land?

Answer: No. Government-owned land cannot be claimed by adverse possession, no matter how long someone occupies it. Only private land may qualify under strict conditions.

4️⃣ Question: Does signing a contract mean you can’t contest it later?

Answer: Not always. If the contract was signed under duress, fraud, or misrepresentation, it can be challenged in court. Consent must be free and informed.

5️⃣ Question: Can an arrested person be held indefinitely without trial?

Answer: No. Under the Nigerian Constitution, an accused must be brought before a court within a reasonable time. Indefinite detention violates fundamental human rights.

6️⃣ Question: Can a company fire an employee without notice?

Answer: Only in cases of gross misconduct. Otherwise, termination must follow the Labour Act or the employee’s contract, including proper notice or compensation.

7️⃣ Question: Is it legal for social media platforms to block accounts without warning?

Answer: Yes, platforms have their own terms of service, which users agree to. However, if a government is involved, there may be regulatory or constitutional issues.

8️⃣ Question: Can a Nigerian citizen marry a foreigner without embassy approval?

Answer: Yes, but the foreign spouse may need a visa, and marriage registration in Nigeria must follow Marriage Act requirements.

9️⃣ Question: Are NDLEA or police search operations legal without a warrant?

Answer: Only under emergency circumstances. Otherwise, searches must be warranted under the Constitution to avoid illegal seizure claims.

10️⃣ Question: Can someone write a will verbally and have it enforced?

Answer: No. In Nigeria, a will must be in writing and signed in the presence of witnesses to be legally valid. Oral wills are generally not recognized.
