After losing his stay of removal in court, he was originally scheduled for deportation on October 14, 2026. However, an administrative error at the airport temporarily delayed his removal.

Adetunji is a citizen of Nigeria. He entered Canada in 2012 and applied for asylum. He was later found inadmissible for serious criminality because of convictions for forgery and reckless driving in the United States during the period from 2003 to 2011.

He was removed from Canada in 2014 but re-entered in 2016, using his brother’s passport. A departure order was issued again, but for several reasons, including difficulty obtaining Nigerian travel documents, it took a long time to enforce. Meanwhile, he was convicted of impaired driving in 2017.

In 2013, he married a Canadian citizen. The couple have three children.

In July 2025, he applied for permanent residence under the spousal sponsorship category. The application was returned as incomplete a month later. In June 2026, a second application was filed and was again returned as incomplete a month later. He then immediately filed a third application, which is still pending.

His removal was initially scheduled for August 19, 2026. He sought a deferral of his removal, citing rehabilitation and the best interests of his children. The removal was then rescheduled for October 14, 2026. On October 1, 2026, his deferral request was denied.

Express Entry Job Offer Points Are Back.

IRCC had earlier removed the CRS points for arranged employment under Express Entry on March 25, 2025. However, these points are set to return under new rules.

Effective November 3, 2026, IRCC will reintroduce additional Express Entry points for eligible Canadian work experience or a qualifying job offer in a high-wage occupation.

Under the new rules, a qualifying job offer will not require an LMIA to receive these new points or to meet job-offer requirements under the Federal Skilled Worker Program and Federal Skilled Trades Program.

Contact Zoe Immigration Consulting Inc. for your Express Entry eligibility assessment.

Your Religion Divorce May Not Be Valid in Canada.

Before sponsoring a second spouse in a Canadian immigration application, ensure your previous marriage was legally dissolved. Otherwise, you may still be deemed legally married to your first spouse, which could result in the refusal of your spousal sponsorship application.

Under section 22 of Canada's Divorce Act, certain foreign divorces may be recognized in Canada. The statutory basis for recognition requires that the divorce be granted by a competent authority, and that either former spouse was habitually resident in the relevant country for at least one year immediately before the divorce proceedings commenced.

Be particularly cautious with divorces obtained solely through religious or customary procedures, as they may not constitute a legal divorce under Canadian law for immigration purposes.

Before submitting your next spousal sponsorship application, verify that your previous divorce is legally valid and recognized in Canada.

Immigration Misrepresentation: Why Applicants Cannot Simply Blame Their Agents: Case Law.

In Musembi v. Canada, decided on October 8th, 2026, the applicant declared in a 2021 Temporary Resident Visa (TRV) application that he had been married since 2018. However, in his 2023 permanent residence application, he stated that he had never been married.

When confronted, he denied knowing the person named in the TRV application and claimed an agency had inserted the information without his knowledge or consent to improve his visa prospects.

The Court rejected his arguments, upheld the immigration officer’s conclusion that he remained responsible for the information submitted in his name, and confirmed his inadmissibility for misrepresentation.

Based on section 40 of the Immigration and Refugee Protection Regulations, a permanent resident or a foreign national is inadmissible for misrepresentation for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act.

The exception for "innocent misrepresentation" is narrow. It applies only in extraordinary circumstances where an applicant honestly and reasonably believes they are not misrepresenting a material fact, the circumstances surrounding the misrepresentation are beyond their control, and they are genuinely unaware of it.

As an applicant, avoid taking unprofessional advice. Submitting false information can have serious immigration consequences. Take responsibility for your applications, and ensure all information is truthful.

Express Entry Candidates: Relevant Credentials in the Field of Work May Matter When Assessing Business Genuineness.

Under Express Entry, the assessment of work experience focuses on the work actually performed, not on having credentials in the field. The applicant only needs to show that they performed the NOC lead-statement activities and a substantial number of its main duties.

However, Anutosh Garg v. Canada has brought in a new twist.

From this latest case, an officer may consider credentials in the field of work when assessing whether the business is genuine.

In other words, when your work duties are significantly different from your credentials or previous work experience, an officer may assess that factor to determine the genuineness of the business.
