Even though the idea of appointing a legal guardian for your loved ones can seem overwhelming, having a plan of action can help. Follow these steps to ensure you’re doing everything you need to set up proper care for your child or dependents.

Determine the type of guardianship needed.

Choose who you would like to be the guardian of your children, dependents, pets, or for yourself.

Come to an agreement with your spouse, if you have one.

Have an open and honest dialogue with the person or people you select. Discuss your wishes with prospective guardians to ensure they’re available, able, and willing to be appointed legal guardians.

Decide how you’ll set up a guardianship. You can go the traditional route of using a face-to-face attorney. You can use an online, free or cheap website. Or, you can use a proven, trusted partner in the industry like Wills & Trust. Will send & Trust was built by lawyers, an experienced legal team who understands the importance of getting it right. So you can trust your future rests in good hands and ironclad documents that ensure your wishes for protecting your children will be followed, exactly how you envision them.

Sign and notarize your guardianship in front of witnesses. Be sure you’re following state mandates for the number and type of witnesses you have.

Here is how to recover money in the account of a loved one who has passed away.

Death happens without notice and that is why everyone needs to have an Estate plan just in case.

However if you find yourself in a situation where your loved one recently passed away and there happens to be money left in the deceased Bank account or accounts, the same can be recovered.

1. Ascertain the amount left. If you don't know you can always approach your bank as the next of kin to declare the amount left.

2. Approach the court. Ask for where the courthouse is located in your locality.

3. Obtain an order of the court and the money will be released to you.

4. Get ready your valid means of identification for the eventual release often money by the bank.

5. Enjoy your money.

Here are five things that will happen to you when you die without an Estate plan.

It is important to understand what an estate plan is.

An estate plan is a plan for the transfer of your assets when you are no more. There is more to Estate Planning than the definition given and I encourage you to go through our profile Secure the future of your loved ones] to learn more.

Now to the five things that will happen when you 'go' without one;

1. The courts will decide how your estate will be shared among your loved ones. You want to avoid this because your loved ones may benefit little.

2. Litigation. Courts consume time, which means matters that require urgency like health & educational decisions will be greatly affected.

3. You give room for intermeddlers. The absence of an estate plan gives room for anybody to lay claim to your properties and assets, you want to avoid this.

4. No provision for the important people in your life. People with special needs etc.

5. Family conflict. This is the most common effect of not having an estate plan. Family members all over will start showing up claiming whatever. This can put your family into disrepute. You want to avoid this trust me.

6. You may lose the businesses you built to your partners without your family carrying on the Mantle. The business world is cruel as they say.

A person who makes a will dictates how his or her estate will be managed, administered or distributed, a person that dies intestate will have his estate administered by the authorities in accordance with the rules of intestacy.

It means that the law determines who gets what.

Dying without a will is, thus, capable of breeding conflict and disharmony within the family left behind; has the potential of incurring more legal costs and the testator’s wishes and best interest are not protected.

To set up your will or need legal advise. You can send us a Dm.
