The Federal Bureau of Investigation (FBI) filed a motion requesting permission to submit confidential, ex parte (private) declarations under seal and in camera (visible only to the judge).
​This request is part of an ongoing Freedom of Information Act (FOIA) lawsuit (Aaron Greenspan v. Executive Office for U.S. Attorneys et al.) filed in the U.S. District Court for the District of Columbia by American transparency advocate Aaron Greenspan. Greenspan has been seeking files from multiple U.S. federal agencies regarding historical law enforcement investigations from the 1980s and 1990s linked to Nigerian President Bola Tinubu.
​Key Details of the Motion
​What the FBI is asking: The FBI asked U.S. District Judge Beryl A. Howell for permission to submit secret filings by August 28, 2026, so the judge can review them privately without making them public.
​Records at issue: Greenspan's requests seek the "entire FBI file" on Tinubu as well as specific 1992–1993 interview records (FBI Form 302s) from a legacy case.
​The Legal Basis (FOIA Exemptions):
​Exemption 7(E): Applied to protect sensitive law enforcement investigative techniques and procedures.
​Exemption 7(F): Applied because the bureau states that public disclosure of certain details "could reasonably be expected to endanger the life or physical safety of any individual".
​Why keep the explanation secret? The FBI argued that it cannot publicly explain why these exemptions apply without accidentally revealing the very confidential law-enforcement details it is trying to protect.
