SHOULD TENANTS BEAR THE FULL COST OF A TENANCY AGREEMENT?

This is one rental practice that deserves more scrutiny.

Here's the question:

If the landlord owns the property, decides to let it out, and engages a lawyer to prepare the tenancy agreement, why should the incoming tenant be required to pay the entire agreement fee?

The tenancy agreement is a legal document that governs the relationship between both parties.

While it creates obligations for both the landlord and the tenant, it is often prepared on the landlord's instructions and is usually drafted to adequately protect the landlord's interests.

From a fairness standpoint, it seems more reasonable for the cost of preparing the agreement to be shared between both parties, rather than placing the entire financial burden on the tenant.

Of course, a lawyer is entitled to be paid for professional services rendered. The real question is who should bear that cost?

Should it be:

-The landlord alone, since the lawyer was engaged by the landlord?

-The tenant alone, as is commonly demanded?

-Or should both parties share the cost because they both benefit from having a written agreement?

The fact that a practice is common does not necessarily make it fair.
