CAN A FAMILY HEAD SELL FAMILY LAND WHEN THE PRINCIPAL MEMBERS REFUSE TO CONSENT?

Where land belongs to the family, the family head does not automatically have the right to treat it as his personal property.

If the principal members whose concurrence is required refuse to consent, the family head cannot secretly sell the land and later claim that his position gives him absolute power.

The law recognizes the role of both the family head and the principal members in the alienation of family land.

A family head who sells family land without the required concurrence may expose the transaction to legal challenge and possible invalidation, depending on the circumstances.

If principal members refuses to consent to sale of family land, there are 3 options available:

1. No Sale. Sale cannot hold. If head forces it, it's voidable and any family member can sue to set it aside.

2. Override their Refusal by obtaining Court Order
The Family Head can go to High Court and prove:

- Sale is for the family necessity (to pay family debt, for burial, to maintain family property, to educate family children)
- Or sale is for family benefit
- And that their refusal is unreasonable

Under S.19 of Administration of Estates Law & the High Court inherent jurisdiction, Court can authorize sale without them.

In the case of MOGAJI v. NUGA (1960), Court said refusal must be reasonable.

3. Remove Them. If they are blocking progress unreasonably, family meeting can remove that branch head and appoint another principal member from same branch. Or remove head if head is the problem.

BEFORE RENTING SHOP STUDY THESE THINGS

1️⃣ WHO ACTUALLY PASSES THERE? 👀
A busy road doesn't automatically mean good business.
Look at the people passing: workers, students, families, traders, drivers, residents, etc.
The important question is: Are the people passing there likely to buy what you sell?
A location can have 2,000 people passing daily and still give you 0 customers if they aren't your target market.

2️⃣ WHAT ARE PEOPLE ALREADY BUYING THERE? 🛍️
Don't just count shops. Observe what people are actually buying.
Which businesses have customers entering regularly?
Which products move quickly?
Which shops always seem active?
This can help you understand the spending behaviour of people around that area.

3️⃣ HOW MANY COMPETITORS ARE AROUND? 😅
Competition isn't automatically bad.
Sometimes, several businesses selling similar products can show that there is demand.
But you need to understand what makes each competitor different.
Price? Location? Customer service? Product quality? Convenience?
Don't enter a street with 15 people selling the same thing and say, “God will make a way.” 😂

4️⃣ WHAT IS THE FOOT TRAFFIC LIKE AT DIFFERENT TIMES? ⏰
Don't inspect the location only at 2PM and make your decision.
Visit in the morning.
Check afternoon traffic.
Check evening traffic.
A place that looks empty during the day may become busy later or the opposite.
Your business hours should match the behaviour of your potential customers.

5️⃣ IS THE SHOP EASY TO FIND AND ACCESS? 🚶🏽‍♂️🚗
Can people easily see the shop?
Can they stop nearby?
Is parking possible?
Can customers enter without struggling?
Is the road accessible during rain?
A beautiful shop that customers struggle to reach can become an expensive decoration. 😂

6️⃣ WHAT OTHER BUSINESSES ARE AROUND IT? 🤝
Look beyond your direct competitors.
A good neighbouring business can bring potential customers into your area.
For example, certain businesses naturally attract people who may also need your products or services.
So before renting, study the entire environment not just the four walls you're about to rent.

7️⃣ WHAT WILL THE TOTAL COST REALLY BE? 💰
Don't calculate only the rent.
Think about electricity, security, service charges, renovation, signage, transportation, taxes/levies and other regular expenses that may apply.
A shop with cheaper rent can become more expensive if the surrounding costs are high.
Don't rent the shop because the landlord said, “My brother, this price is for you.” 😂
Calculate properly before committing.

COMMON LANDLORD MISTAKES — Especially for First-Time Landlords

Many landlords focus on collecting rent but overlook the systems that protect the property and the tenancy.

1. ❌ Choosing a tenant based only on appearance

A tenant may look responsible but still have poor payment or tenancy history.

Better: Conduct proper tenant screening and obtain references where appropriate.

2. ❌ Renting without proper documentation

Verbal agreements can create serious disputes later.

Better: Have a clear written tenancy agreement covering rent, duration, responsibilities, permitted use, termination and other important terms.

3. ❌ Failing to inspect the property

Some landlords only visit when rent is due.

Better: Carry out reasonable inspections in accordance with the tenancy agreement and applicable law, with appropriate notice.

4. ❌ Mixing personal and property finances

Without proper records, landlords may not know exactly what they earned or spent.

Better: Keep records of rent, repairs, agency/management fees and other property expenses.

5. ❌ Ignoring maintenance problems

A small leak or electrical fault can become an expensive problem.

Better: Respond promptly to genuine maintenance issues and keep records of repairs.

6. ❌ Increasing rent without proper notice or legal compliance

A landlord shouldn't simply announce a new rent and expect the tenant to accept it immediately.

Better: Check the tenancy agreement and applicable state law before implementing a rent increase.

7. ❌ Allowing rent arrears to continue indefinitely

Waiting too long can make recovery more difficult.

Better: Have a clear rent-monitoring and reminder system and take lawful steps when arrears arise.

8. ❌ Using self-help to remove a tenant

Changing locks, disconnecting utilities or physically forcing a tenant out can create legal problems.

Better: Follow the applicable notice and lawful possession/recovery process.

9. ❌ Failing to keep copies of important documents

Landlords sometimes lose track of agreements, receipts and correspondence.

Better: Maintain a property file containing the tenancy agreement, payment records, notices, inspection reports and relevant correspondence.

10. ❌ Managing a property emotionally

Personal disagreements with tenants can easily become business disputes.

Better: Keep communication professional and apply the tenancy terms consistently.

⭐ A simple rule for landlords

Screen properly → Document everything → Collect rent on time → Maintain the property → Communicate professionally → Follow the law.

For a landlord who doesn't want to handle these responsibilities personally, professional property management can provide a structured system for rent collection, tenant communication, inspections, maintenance coordination and documentation.
