Today, we had the privilege of representing our client in Melaka, who was charged under Section 39A(1) of the Dangerous Drugs Act 1952.

Upon due consideration, the Prosecution accepted our representation, and the charge proffered against our client was withdrawn and the client was accordingly discharged.

⚖️ Court Victory | High Court of Malacca

The High Court of Malacca called for a revision in a case originally charged under Section 379 Penal Code (theft), and allowed the revision.

The RM1,500 fine was set aside and replaced with a Bond of Good Behaviour under Section 294 of the Criminal Procedure Code for 2 years, with the fine paid to be refunded.

The matter was led by our partner, Mr Amritpal Singh, assisted by Mr Sharveen, Mr Goh, and Mr Francis, achieving a positive outcome that reflects the Court’s commitment to principled and reformative sentencing.

Decision at the Magistrate’s Court, Melaka.

Our client was charged under Section 457 of the Penal Code, which provides:

“Whoever commits lurking house-trespass by night or house-breaking by night, in order to commit any offence punishable with imprisonment, shall be punished with imprisonment for a term which may extend to five years and shall also be liable to fine; and if the offence intended to be committed is theft, the term of imprisonment may be extended to fourteen years.”

After the close of the prosecution’s case, full trial and submissions, the Learned Magistrate held that the prosecution had failed to establish a prima facie case.

The accused was accordingly discharged and acquitted.

⚖️ Acquittal at Raub Sessions Court

Today, the Learned Sessions Court Judge at Raub acquitted our client after a full trial.

The charge, initially framed under Section 14 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007, was later amended to Section 48(1) of the Child Act 2001. Upon the close of the defence case, the Court found that the defence had raised a reasonable doubt.
