LEGAL CLARITY ON LAND OFFICE DUTIES: SYARIAH COURT ORDERS VS. CIVIL PROBATE

The Malaysian Bar and the Director General of Lands and Mines (JKPTG) have issued Circular No. 077/2026 to clarify the responsibilities of Land Registrars regarding Syariah High Court orders affecting land registration.

* Recognition of Syariah Orders: Under Section 421A of the National Land Code, Land Registrars and Administrators have a statutory duty to give effect to valid directions or orders from the Syariah High Court in the same manner as orders of the Civil High Court.

* The Constitutional Boundary: Matters relating to probate, letters of administration, and the administration of estates fall strictly within the Federal List of the Federal Constitution.

* What is NOT Registrable: Syariah Court orders or Faraid certificates relating to probate or letters of administration are not registrable instruments at the Land Office.

* Critical Message to the Public: Notwithstanding the recognition provided by Section 421A, parties are still required to obtain a valid civil grant of probate or letters of administration from the Civil High Court before any registration or dealing affecting land can be effected.

Failure to follow the correct civil procedure may result in actions being deemed ultra vires and in conflict with the Federal Constitution. Ensure your estate dealings are compliant with both the National Land Code and Constitutional law.

KEJELASAN UNDANG-UNDANG MENGENAI TANGGUNGJAWAB PEJABAT TANAH: PERINTAH MAHKAMAH SYARIAH VS. PROBET SIVIL

Badan Peguam Malaysia dan Ketua Pengarah Tanah dan Galian Persekutuan (JKPTG) telah mengeluarkan Surat Edaran Bil 1/2026 bagi menjelaskan tanggungjawab Pendaftar Tanah berkaitan perintah Mahkamah Tinggi Syariah yang melibatkan pendaftaran tanah.

* Pengiktirafan Perintah Syariah: Di bawah Seksyen 421A Kanun Tanah Negara, Pendaftar atau Pentadbir Tanah mempunyai kewajipan statutori untuk memberi kesan kepada arahan atau perintah sah daripada Mahkamah Tinggi Syariah sepertimana pelaksanaan perintah Mahkamah Tinggi Sivil.

* Sempadan Perlembagaan: Hal-hal berkaitan probet, surat kuasa mentadbir, dan pentadbiran harta pusaka jatuh di bawah Senarai Persekutuan dalam Perlembagaan Persekutuan.

* Apa yang TIDAK Boleh Didaftarkan: Perintah Mahkamah Syariah atau sijil faraid yang berkaitan dengan probet atau surat kuasa mentadbir bukanlah instrumen yang boleh didaftarkan di Pejabat Tanah.

* Mesej Kritikal kepada Awam: Walaupun terdapat Seksyen 421A, pihak-pihak tetap diwajibkan untuk mendapatkan geran probet atau surat kuasa mentadbir sivil yang sah daripada Mahkamah Tinggi Sivil sebelum sebarang pendaftaran atau urusan tanah boleh dilaksanakan.
