PEMAJU LEWAT SIAPKAN RUMAH πŸ₯²

SEBAGAI PEMBELI, 10 PERKARA INI YANG PATUT ANDA LAKUKAN

Saya percaya ramai pembeli yang menghadapi masalah kelewatan pemaju menyiapkan rumah yang mereka beli.

Pinjaman dengan bank sudah mula kena bayar, tetapi rumah yang dibeli masih belum siap-siap lagi. Masih terpaksa duduk menyewa lagi.

Pastinya perkara tersebut akan membebankan anda bukan?

Maklum sahajalah anda terpaksa membayar pinjaman bank dan sewa rumah secara serentak.

Tahukah anda, mengikut Perjanjian Jual Beli yang menggunapakai Jadual G dan H di bawah Akta Pemajuan Perumahan (Kawalan dan Pelesenan) 1966, pemaju hendaklah menyiapkan pembinaan sesuatu rumah dan menyerahkan milikan kosong (dalam bahasa mudahnya, serahkan kunci rumah) kepada pembeli dalam tempoh 24 bulan (untuk rumah landed) dan 36 bulan (untuk rumah strata) daripada tarikh Perjanjian Jual Beli.

Sekiranya pemaju gagal menyiapkan pembinaan rumah dan gagal menyerahkan milikan kosong rumah tersebut dalam tempoh yang ditetapkan, apakah yang boleh pembeli lakukan?

Bolehkah pembeli menamatkan atau membatalkan Perjanjian Jual Beli (SPA)?

Bolehkah pembeli saman pemaju?

Di sini saya senaraikan tindakan-tindakan yang boleh dilakukan oleh pembeli sekiranya pemaju lewat menyerahkan milikan kosong rumah:

1. Tidak boleh batalkan SPA

Sebenarnya Pembeli tidak boleh menamatkan atau membatalkan SPA semata-mata disebabkan pemaju lewat serah milikan kosong rumah, walaupun tempoh 24 bulan daripada tarikh SPA telah tamat. Ini kerana tiada sebarang peruntukan di dalam SPA di bawah Jadual G yang membenarkan Pembeli melakukan tindakan sedemikian. Ini bermakna, selama mana sekalipun pemaju lewat, pembeli tidak boleh membatalkan SPA.

2. Surat rasmi kepada pemaju

Sekiranya berlaku kelewatan, pembeli boleh tulis surat rasmi kepada pemaju memaklumkan yang penyerahan milikan kosong sepatutnya dibuat kepada pembeli pada sekian haribulan & sehingga kini pemaju telah lewat menyerahkan milikan kosong rumah tersebut. Maklumkan juga kepada pemaju yang pemaju bertanggung jawab untuk menjelaskan bayaran gantirugi kelewatan serahan milikan kosong kepada pembeli sebaik sahaja milikan kosong rumah tersebut dibuat kelak.

3. Salinan kepada KPKT dan pos berdaftar

Serahkan juga salinan surat rasmi tersebut kepada Kementerian Perumahan dan Kerajaan Tempatan (KPKT). Ingat! Surat tersebut hanya boleh diserahkan kepada Pemaju dan KPKT menggunakan pos berdaftar atau serahkan secara serahan tangan sahaja.

4. Tujuan salinan KPKT

Tujuan salinan surat tersebut di serahkan kepada KPKT juga adalah untuk memaklumkan kepada KPKT yang projek tersebut telah berlaku kelewatan dan KPKT akan memantau dengan lebih dekat lagi projek tersebut. Secara tidak langsung ia memberi tekanan kepada pmaju untuk mempercepatkan kesiapan projek tersebut dan seterusnya menyerahkan milikan kosong rumah tersebut dengan segera.

5. Tunggu milikan kosong

Seterusnya, tunggulah sehingga milikan kosong diserahkan kepada anda secara rasmi.
Selama tempoh tersebut, tidak banyak yang pembeli boleh lakukan melainkan sekadar follow up dengan pemaju dari masa ke semasa.

6. Milikan kosong, kunci dan CCC

Selepas rumah siap sepenuhnya & Sijil Perakuan Siap dan Pematuhan (CCC) dikeluarkan oleh Arkitek utk memperakukan bahawa rumah tersebut adalah selamat dan layak diduduki, maka pemaju hendaklah menyerahkan milikan kosong rumah tersebut bersekali dengan kunci rumah dan salinan CCC kepada pembeli.

7. Denda lewat

Sebenarnya, dalam SPA mensyaratkan sekiranya berlaku kelewatan serahan milikan kosong, pemaju hendaklah pada masa penyerahan milikan kosong tersebut membayar sekali denda lewat kepada pembeli, walaupun tanpa dituntut oleh pembeli. Tetapi saya percaya hampir tiada pemaju yang mempraktiskannya. Kebanyakan mereka, hanya buat tak tahu sahaja atau buat-buat lupa. Apabila pembeli tanya, mereka akan mintak pembeli yang membuat tuntutan terhadap mereka, atau mereka akan memberi pelbagai alasan supaya pembeli tidak menuntut daripada mereka. Perkara ini amat bertentangan dengan Akta Pemajuan Perumahan sebenarnya.

8. Jumlah denda lewat

Berapakah jumlah denda lewat yang pemaju kena bayar kepada pembeli?

Jumlah bayaran denda lewat serahan milikan kosong yang perlu dijelaskan oleh pemaju kepada pembeli adalah pada kadar sepuluh peratus (10%) setahun daripada harga jual beli, dikira dari hari ke hari, mulai dari tarikh luput penyerahan pemilikan kosong sehingga tarikh sebenar. Pembeli mengambil pemilikan kosong rumah tersebut.

Contohnya:
Harga jual beli: katakanlah RM200,000.00

Jumlah hari lewat (dikira mulai daripada tarikh sepatutnya pemaju serah milikan kosong sehinggalah tarikh sebenar pembeli ambil milikan kosong): katakanlah 100 hari. Maka perkiraan untuk bayaran denda lewat serahan milikan kosong adalah seperti berikut:

RM200,000.00 x 100 hari lewat x 10% (kadar % denda lewat) / 365 hari (setahun) = RM5,479.45

9. Jika pemaju tidak bayar

Sekiranya pemaju tidak bayar denda tersebut pada masa serahan milikan kosong dibuat, anda boleh tulis surat rasmi kpd pemaju menuntut byrn denda lewat serahan milikan kosong dibuat kpd anda dlm tempoh 14 HARI daripada tarikh penerimaan surat tersebut. Hantar juga salinan surat tersebut kepada KPKT.

10. Tribul pembeli rumah

Sekiranya pemaju masih gagal menjelaskan bayaran denda lewat tersebut, anda boleh failkan tuntutan di Tribunal Pembeli Rumah dan kes akan didengar dan diputuskan dalam tempoh 40 HARI daripada tarikh pemfailan.

Sebenarnya semua yang saya tulis di atas telah dinyatakan dengan jelas dalam SPA.

Tetapi disebabkan majoriti Pembeli tidak baca SPA semasa atau selepas menandatandatanganinya, ini mengakibatkan mereka tidak tahu akan hak-hak mereka.

Oleh itu jom sama-sama kongsikan maklumat ini supaya lebih ramai pembeli rumah baru dengan pemaju tahu dan faham akan hak-hak mereka.
