If an artwork is created by AI, who owns the copyright?
Under the Malaysian Copyright Act 1987, copyright protection requires a work to be created by a “qualified person.” AI does not have citizenship, nationality or legal personality, so it cannot own copyright.
But does that mean you automatically own the copyright? Not necessarily.
If you simply type a basic prompt and use the AI-generated output as it is, there may not be enough human creativity or original input for copyright protection.
However, if you make meaningful creative contributions, such as selecting, arranging, editing or significantly modifying the AI output, your human contribution may be capable of attracting copyright protection.
⚠️ And there’s another thing you shouldn’t overlook: the AI platform’s Terms & Conditions.
Different AI tools have different rules on IP ownership and usage rights. Some may allow you to retain rights, while others may impose restrictions.
👉 Bottom line: AI cannot own copyright, but your human creative input and the AI platform’s Terms & Conditions can make a big difference.
⚖️ As Malaysian courts have yet to directly rule on AI-generated works, this remains an evolving area of copyright law.
