Bekas Setiausaha Politik Kanan kepada Perdana Menteri, Datuk Seri Shamsul Iskandar Mohd Akin merayu keputusan Mahkamah Tinggi yang menolak permohonan beliau memindahkan lima tuduhan rasuah dihadapinya, daripada Mahkamah Sesyen ke Mahkamah Tinggi.

Pada 28 April lalu, Hakim Mahkamah Tinggi, Noor Ruwena Md Nurdin menolak permohonan Shamsul Iskandar dengan memutuskan beliau selaku pemohon tidak memenuhi syarat mengikut seksyen 417 Kanun Tatacara Jenayah.

Pada prosiding sebutan kes itu di Mahkamah Sesyen hari ini, peguam bela Shamsul Iskandar, Datuk Amer Hamzah Arshad memaklumkan kepada mahkamah, pembelaan sudah memfailkan notis rayuan di Mahkamah Rayuan pada 6 Mei lalu.

Suzana kemudian menetapkan pada 29 Jun ini bagi sebutan semula kes.

Pihak pembelaan Shamsul Iskandar termasuk peguam Joshua Tay dan pelatih dalam kamar Michelle Chew.

Former senior political secretary to the Prime Minister, Datuk Seri Shamsul Iskandar Mohd Akin has filed an appeal against the High Court’s decision to reject his application to transfer five corruption charges from the Sessions Court to the court.

Lawyer Datuk Amer Hamzah Arshad, representing Shamsul Iskandar, informed Judge Suzana Hussin that his party had filed the application at the Court of Appeal on 6 May.

On 28 April, High Court Judge Noor Ruwena Md Nurdin rejected the application because it did not meet the requirements under section 417 of the Criminal Procedure Code.

The court then set the case management for 29 June.

Lawyers Amer Hamzah Arshad and Joshua Tay, and pupil in chambers Michelle Chew, among others, appeared for him.

Lawyers for Datuk Seri Shamsul Iskandar Mohd Akin told the Sessions Court that they have filed an appeal against last month’s ruling which denied their request to transfer his graft case to the High Court.

Datuk Amer Hamzah Arshad of Messrs AmerBon said they are not applying for a stay of the hearing date, as they have yet to receive the full documents for this trial.

On 28 April, High Court judge Noor Ruwena Md Nurdin had dismissed the application by Shamsul Iskandar, former senior political secretary to Prime Minister Datuk Seri Anwar Ibrahim, to transfer his graft case to the High Court.

"As the law is settled on this issue, I see no reason to depart from established judicial precedent, some of which are binding [...]," she said in dismissing the transfer.

The defence team includes lawyers Amer Hamzah Arshad and Joshua Tay, and pupil in chambers Michelle Chew.

Construction company Mamfor Sdn Bhd’s donations totalling RM19.5 million to political party Parti Pribumi Bersatu Malaysia in 2021 and 2022 were unusual because of the way the payments were made, the High Court heard today in Bersatu president Tan Sri Muhyiddin Yassin’s corruption and money laundering trial.

Bank Muamalat’s PKNS Shah Alam assistant branch manager Norazeanti Miswan said it was unusual in this case, as Mamfor had issued multiple cheques on the same day to the same recipient Bersatu.

When asked by Muhyiddin’s lead defence lawyer Datuk Amer Hamzah Arshad, Norazeanti agreed that an “unusual” or “questionable” transaction does not necessarily mean that it is an “unlawful” transaction.

Norazeanti agreed with Amer that construction is a legitimate business and that it would mean Mamfor had obtained its funds through legitimate activities, also agreeing that the company is entitled to decide how to spend its money.

She agreed with Amer that it would be up to Mamfor to decide to give donations, and that giving donations is generally not an offence.

Muhyiddin’s defence team included lawyers Joshua Tay and Lee Yee Woei, and pupil in chambers Michelle Chew.

Would the current Negeri Sembilan Menteri Besar lose his position just because a group of lawmakers publicly declare that they have lost confidence in him?

Constitutional lawyers told Malay Mail that the best way or “gold standard” is still for lawmakers to vote on whether they have lost confidence in the Menteri Besar, and that this vote should be done in Negeri Sembilan’s state legislative assembly or Dewan Undangan Negeri (DUN).

Constitutional lawyer New Sin Yew said it has to be proved that a menteri besar “had ceased to command the confidence of the majority of the state legislative assembly (SLA)”, and gave examples of how such uncertainties have been resolved in the past.

“This can be done in various ways — vote of confidence in a SLA sitting, statutory declarations, interview by the ruler,” he told Malay Mail, basing this on similar past cases in Perak, Selangor, Sabah and at the federal government level.

In the case of the 2009 Perak constitutional crisis, the Federal Court in 2010 decided that the question of whether an MB still has majority support can be determined by other methods, as “there is no requirement in the State Constitution which requires a vote of no confidence to be tabled” in the Perak legislative assembly.

Previously, Malaysia had seen MPs filing in statutory declarations, as well as the Yang di-Pertuan Agong having to step in and interview MPs in 2020 and 2022 to decide who is likely to have majority support to be the prime minister.

While other methods have been accepted in the past, New indicated that a mere press conference would not be enough.

“So I don’t think just 14 people holding a press conference is in itself sufficient to say that MB has lost confidence,” he said.

“But I suppose the gold standard is through the DUN vote of no confidence,” he concluded.

Seorang pegawai bank memaklumkan Mahkamah Tinggi di sini hari ini bahawa hampir kesemua transaksi derma RM19.5 juta kepada Parti Pribumi Bersatu Malaysia (Bersatu) disertakan dengan surat sokongan (cover letter) yang menyatakan hasrat mereka untuk membuat sumbangan kepada parti politik itu.

Ketika disoal balas oleh peguam bela, Datuk Amer Hamzah Arshad yang mewakili bekas Perdana Menteri, Tan Sri Muhyiddin Yassin, Penolong Pengurus Cawangan Bank Muamalat PKNS Shah Alam, Norazeanti Miswan bersetuju bahawa semua cek jurubank (banker’s cheque) dan transaksi dilakukan Mamfor Sdn. Bhd. adalah telus.

The High Court heard today that construction company Mamfor Sdn Bhd sent letters to Bersatu expressing its intention to make monetary contributions to the party.

Continuing her testimony in former prime minister Muhyiddin Yassin’s corruption trial, Norazeanti Miswan, an assistant manager at Bank Muamalat’s PKNS Shah Alam branch, said the letters were attached to remittance forms used to transfer funds to Bersatu.

The ninth prosecution witness also testified that the branch flagged the transactions and submitted questionable activity reports to its headquarters because of the unusual frequency and large sums involved.

During cross-examination by Muhyiddin’s counsel, Amer Hamzah Arshad, she agreed with Amer’s assertion that the filing of the questionable activity reports over unusual transactions did not in itself mean the transactions were unlawful.

She also agreed with the defence that based on the supporting letters and accompanying documents, the contributions were meant for Bersatu and not Muhyiddin personally.

Shamsul Iskandar Akin, a former senior political secretary to the Prime Minister, failed in his application to transfer his five corruption charges from the Sessions Court to the High Court.

High Court judge Noor Ruwena Nurdin dismissed the application, saying he fell short of the threshold under section 417 of the Criminal Procedure Code.

In the application filed in February, Shamsul’s lawyer, Amer Hamzah Arshad, cited novel legal questions and complex issues which he argued warranted determination by the High Court and, ultimately, the Federal Court.

In a supporting affidavit, Shamsul said the case would involve numerous witnesses, extensive documentary evidence, and complex legal procedures, making the expertise of a High Court judge essential to ensure smooth proceedings and to save time and costs.

Shamsul’s legal team included lawyers Amer Hamzah Arshad and Joshua Tay, and pupil in chambers Michelle Chew Shar Yee.

Prime Minister Datuk Seri Anwar Ibrahim’s former senior political secretary Datuk Seri Shamsul Iskandar Mohd Akin has failed in his bid to transfer his graft case to the High Court.

Judge Noor Ruwena Md Nurdin on Tuesday ruled that Shamsul had failed to satisfy the threshold per the law.

Datuk Amer Hamzah Arshad, appearing for Shamsul Iskandar, and deputy public prosecutor Farah Ezlin Yusop Khan had previously submitted on the matter earlier this month.

Shamsul is facing five charges under Section 17 of the MACC Act for allegedly accepting cash from businessman Albert Tei Jiann Chieng in connection with his official duties.

Shamsul’s legal team included lawyer Joshua Tay and pupil in chambers Michelle Chew Shar Yee.

Unusual and suspicious banking activities do not automatically point to unlawful activity, the High Court heard on Wednesday.

Testifying in former Prime Minister Tan Sri Muhyiddin Yassin’s ongoing power abuse and money laundering trial, banker Norazeanti Miswan also agreed with the defence that despite being flagged as suspicious, the transactions totalling RM19.5 million, which were channelled from a local construction firm to the former PM's political party, were all subsequently approved.

The assistant branch manager at Bank Muamalat Malaysia Bhd’s PKNS Shah Alam branch said this in reply to defence attorney Datuk Amer Hamzah Arshad's question regarding the internal red flags raised over the volume and frequency of funds given by Mamfor Sdn Bhd to Parti Pribumi Bersatu Malaysia (Bersatu) from 12 May 2021 to 16 November 2022.

She also agreed with the defence that Mamfor was a legitimate business and had no red flags raised to indicate that it was engaged in unlawful activities.
