This is one of the most common questions we hear from trademark applicants.

The truth is, there is no one-size-fits-all answer.

Before deciding whether to continue with your application or walk away, it is important to understand *why* your trademark is being opposed.

One of the most common grounds of opposition is similarity and confusion.

In other words, the opponent may claim that your trademark is too similar to its trademark and that consumers are likely to be confused.

But does that automatically mean you should give up?

Not necessarily.

Factors such as the similarity of the trademarks, the goods or services involved, the target customers and the overall impression created by the trademarks may all be relevant.

The clearer the picture, the better positioned you will be to make an informed decision.

What can you do next?

Can you ignore it?

Generally, no - unless you wish to abandon your trademark application.

In Malaysia, upon receiving a Notice of Opposition, you are generally required to file a Counter-Statement within 2 months from the date you are served with the Notice.

Failing to do so may result in your trademark application being deemed withdrawn.

As such, it is important to seek legal advice as early as possible so that you have sufficient time to prepare your response.
