Can the word "Sultan" be registered as a trademark in Malaysia?

Sultera Malaysia has to rebrand to "Sultera" as the word "Sultan" (to be used in business) has been rejected by both the local authority and the intellectual property office (MyIPO). Under the Malaysian trademark laws, regulation 4(1)(c) of the Trademarks Regulations 2019 reads: words referring to YDPA, Ruler of a State shall be refused for trademark registration. Moreover, confusion may also arise as to whether the "Sultan business" is indeed associated with or endorsed by the Ruler / royal or not.

The word "Sultan" may often feel "premium" or "atas" to certain consumers due to its meaning in Malaysia. It is only natural that such a word is preferred and being used in trade.

Nevertheless, it is interesting to find that some companies have actually successfully registered the word "Sultan" for their products with the MyIPO. The question would be whether these companies are allowed to use their registered trademark freely? and whether these registered trademarks would be susceptible to challenge, by local authority or MyIPO or court?
