🤔 Common Misconceptions About Probation in Malaysia 🇲🇾

Let's clear the air on some of the misunderstood beliefs when it comes to probationary periods in the workplace.

🔴 "Probationers have no legal rights."
✅ Truth: Probationers are still employees under Malaysian Law. This means you are entitled to a notice period, wages, leave entitlements, protection against unfair dismissal --- just like permanent employees.

🔴 "Probationers can be fired anytime for any reason"
✅ Truth: Proper procedure must be followed and a valid reason (just cause and excuse) must be provided before terminating a probationer. YOU CAN'T BE LET GO ON A WHIM!

🔴 "Probationers are not entitled to benefits like medical leave or EPF."
✅ Truth: You are entitled to EPF & SOCSO contributions from the first day of employment—even during probation. Your entitlements to medical or annual leave shall depends on what's outlined in your employment contract but shall be in accordance to the Labour Law.

🧩 Myth #1: No Contract = No Agreement
🔍 Reality: A contract doesn’t have to be written to be legally binding!

Yes, verbal agreement may hold up in court, provided that there is sufficient proof (e.g. messages, witnesses etc) to prove the existence.

🧩 Myth #2: Police can search your phone anytime they want
🔍 Reality: Police must have REASONABLE CAUSE or a WARRANT to search your phone.

🧩 Myth #3: As a Landlord, I can kick my tenant out without notice
🔍 Reality: Landlord must give sufficient and proper notice before evicting a tenant. A common notice period is 30 days unless otherwise stated in a signed agreement. Therefore, it is important to have a tenancy agreement properly drafted to better protect your interest!

🧩 Myth #4: Cyberbullying isn't a serios crime
🔍 Reality: Cyberbullying, harassment, and threats online can lead to charges under Communications and Multimedia Act 1998 and Penal Code.

🧩 Myth #5: Mental Illness means you can't be charged with a crime
🔍 Reality: Having a mental health condition does not automatically exempt you from criminal liability. The court will assess the mental state at the time of the offence under the Penal Code.

Defamation is an act of making false statements that damage someone's reputation. With the rise of digital media, it has become more and more easy for online user to spread defamatory content.

In Malaysia, defamation laws are governed by both civi and criminal law including Defamation Act 1957, Sedition Act 1948, Communications and Multimedia Act 1998 and Penal Code. The key elements of Defamation are:-

1️⃣The Statement is defamatory which lower the reputation of the Plaintiff in the eyes of the public;
2️⃣The Statement refers to the Plaintiff or be identifiable as referring to them;
3️⃣The Statement was published to a third party other than the Plaintiff.
