In this article, José Antonio Cervantes Acosta explains that, following a recent decision of Mexico’s Supreme Court of Justice, shareholders may request financial and corporate information from directors through pre-trial proceedings without the need of calling a shareholders’ meeting and even without prior notice to the affected parties.

The note highlights that this mechanism increases directors’ exposure, as failure to maintain updated and accessible corporate records may lead to personal liability, reinforcing the need for constant compliance and readiness.

In this article, José Antonio Cervantes Acosta explains that, following the decision of Mexico’s Supreme Court of Justice in Constitutional Trial (Amparo en Revisión 557/2025), an arbitration clause selecting a foreign seat does not prevent Mexican courts from ordering provisional measures over assets located in Mexico, such as freezing bank accounts, even while the merits are resolved abroad.

In this article, José Antonio Cervantes Acosta explains that, following recent decisions by the Supreme Court of Justice of Mexico, judges in Mexico may review and reduce agreed interest rates in credit transactions, even between commercial entities, if they are deemed excessive or abusive, regardless of whether the debtor raises the issue.

The note highlights that this standard applies broadly to any creditor, requiring companies that grant credit in Mexico to ensure that interest rates are reasonable and supported by market conditions, as judicial adjustment may directly impact enforcement and financial expectations.

In this note, José Antonio Cervantes Acosta explains that, under recent binding case law in Mexico, jurisdiction clauses designating a specific court may be disregarded when included in adhesion contracts, as they do not reflect a real negotiation between the parties, limiting their effectiveness to determine territorial jurisdiction.

The note highlights that, in such cases, Mexican courts may instead assume jurisdiction based on the domicile of the adhering party (typically the debtor), prioritizing access to justice and exposing companies to the risk of litigating disputes in unforeseen venues.

On June 8, 2026, Congresswoman Ana Karina Rojo Pimentel submitted before the Chamber of Deputies a bill containing a draft decree aimed at amending various provisions of the Civil Aviation Law and the General Law for the Inclusion of Persons with Disabilities.

The central objective of this proposal is to redefine the legal and operational treatment of assistive medical devices in commercial flights, explicitly including respiratory support equipment. Among its most relevant aspects, the bill seeks to legally separate such devices from the conventional concept of baggage, establish an obligation for their transportation without additional charges, and expand the civil liability regime of concessionaires and permit holders in the event of damage to such devices during the provision of the service.

In the following carousel, we present the articles proposed to be amended.
