⚠️ WARNING ABOUT A POSSIBLE “HOTEL INVESTMENT” SCHEME ⚠️
A so-called “investment opportunity” is currently being promoted involving a hotel that does NOT own the land on which it is built.
The land only has an “Acta de Posesión” (Possession Certificate) in the name of a Mexican citizen. It is important to understand that an Acta de Posesión is NOT a property title. The person listed in that document is not the legal owner of the land; they only hold possession.
Despite this, people are being encouraged to invest money in the hotel, with promises of high returns, based solely on a contract for the use of the land with the possessor.
This situation carries extremely serious risks:
❗ The possessor can transfer or sell the possession rights to another person.
❗ The possessor could lose possession in a legal dispute if the true owner appears.
❗ Multiple parties could claim possession or ownership of the land.
❗ The land-use contract may not be enforceable against third parties.
❗ If possession changes hands, the new possessor may have no obligation to honor the hotel’s contract.
❗ Investors would have no real property rights over the land or the building.
❗ In a legal conflict, the project could even face eviction or demolition orders.
The key question is simple:
👉 If the person holding possession transfers or loses those rights, what happens to the investors’ money?
Before investing in any real estate project, always verify who the legal owner of the land is and whether the property is properly registered in the Public Registry of Property.
Not every “real estate investment opportunity” is what it claims to be. In some cases, investors may simply be financing a project built on a legally fragile situation.
