We are pleased to share a significant achievement by our Intellectual Property Litigation team.

The Mexican Supreme Court has ruled that when priority rights are claimed in an industrial design application but a formal requirement—such as submitting a Spanish translation—is not fulfilled, the Mexican Institute of Industrial Property (IMPI) must provide the applicant with an opportunity to correct or remedy the omission, rather than denying recognition of the priority right, as had previously been the practice. This landmark decision, now mandatory for all cases, strengthens legal certainty in the protection of industrial designs.

We are proud to have contributed to this outcome and reaffirm our commitment to protecting intellectual property rights in Mexico.

Nos complace compartir un logro significativo de nuestro equipo de litigio de Propiedad Intelectual.

La Suprema Corte de Justicia de México resolvió que cuando se reclama un derecho de prioridad en una solicitud de diseño industrial, pero no se cumple con un requisito formal—como la presentación de la traducción al español—el Instituto Mexicano de la Propiedad Industrial (IMPI) debe otorgarle al solicitante la oportunidad de corregir o subsanar su error, en vez de negar el reconocimiento al derecho de prioridad, como lo había venido haciendo. Esta decisión histórica, ahora de aplicación obligatoria, fortalece la seguridad jurídica en la protección de diseños industriales.

Nos enorgullece haber contribuido con este resultado y reafirmamos nuestro compromiso con la protección de los derechos de propiedad intelectual en México.
