Answer to a question I got this morning about ex's owning a house together with title and mortgage in both names. What are the options? Read on...

ANSWER

Yes, you always have rights. As the co-owner of the property and holder of the mortgage, you have significant rights. The mortgage company will likely not let you off the mortgage unless if is refinanced into his name only. As for title, I assume the property is help as joint tenants with right of survivorship. If he will not voluntarily sign the property over, of "quit claim" it to you, you can file a partition action to sever the joint tenancy. You will then hold the property as tenants in common, each with a right to an undivided one half interest. This is very cumbersome and probably not where you want to end up. If he's not willing to let the house go into foreclosure, see if he will short sell the property. Short sale is a better option because it does not hurt your credit as much as foreclosure.
