This initiative is a response to the devastating impact of the earthquake on the victims at the epicentre of Sagaing.

Recognizing the urgent need for assistance, Khaing Khaing Kyaw Myanmar Traditional Restaurant, along with their compassionate team, will travel to Sagaing on April 3, 2025. They will establish a cooking camp to provide freshly prepared meal boxes and essential water supplies to those in need, continuing their efforts until April 6, 2025. On July 1, 2024, the Myanmar Intellectual Property Department (IPD) published the July issue of the Trademark Journal to notify the public about the ongoing trademark registration processes. This publication provides a comprehensive overview of 1081 marks, representing a significant increase from previous editions. The list encompasses 163 domestic marks and 918 foreign marks, demonstrating a diverse array of trademark applications. IPD issued the second edition of the Trademark Journal

On June 1st 2024, the Myanmar Intellectual Property Department (IPD) issued the second edition of the Trademark Journal to inform the general public regarding the trademarks currently undergoing registration. This announcement comprehensively details 500 marks, encompassing information about each entry. Specifically, the list covers 81 locally owned and 419 foreign owned marks, reflecting a broad spectrum of trademark applications. The deadline to file opposition in connection with this publication is July 31st, 2024.

Myanmar Long-Awaited Patent Law Comes into Effect

On the 1st of June 2024, Notification 106/2024 was released by the State Administration Council, indicating the enactment of the Patent Law (Pyidaungsu Hluttaw Law No. 7 of 2019) effective from the 31st of May 2024, in accordance with Sub-Section (b) of Section 1 of the aforementioned law. This notification is endorsed by the Chairman of the State Administration Council.

In relation to patent registration, we anticipate that the Ministry of Commerce and the Intellectual Property Agency will release regulations and fee schedules by the end of June.

တီထွင်မှုမူပိုင်ခွင့်ဥပဒေ (Patent Law) စတင်၍ အာဏာတည်ပြီးနောက် တီထွင်မှုမူပိုင်ခွင့်မှတ်ပုံတင်ခြင်းနှင့် စပ်လျဥ်းသော နည်းဥပဒေနှင့် မှတ်ပုံတင်ခြင်း ဆိုင်ရာ အခကြေးငွေသတ်မှတ်ချက်များကို သက်ဆိုင်ရာ ဝန်ကြီးဌာန နှင့် မူပိုင်ခွင့်အေဂျင်စီတို့မှ ဇွန်လ အတွင်း ထုတ်ပြန်ကြော်ငြာနိုင်ဖွယ်ရှိသည်။

မူပိုင်ခွင့်ဦးစီးဌာ၏ ထုတ်ပြန်ကြေညာချက်တွင် အမှတ်တံဆိပ် စုစုပေါင်း ၂၂၀ပါဝင်ပြီး ပြည်တွင်းအမှတ်တံဆိပ် ၂၄ ခု နှင့် ပြည်ပအမှတ်တံဆိပ် ၁၉၆ ခုပါဝင်သည်ကို တွေ့ရှိရသည်။ မူပိုင်ခွင့်ဌာန အနေဖြင့် ထုတ်ပြန်ကြေငြာချက်များကို ၁၄ ရက် တစ်ခါဖြစ်စေ ၁လ တစ်ခါဖြစ်စေ လုပ်ဆောင်မည်ဟု ကနဦး သိရှိရသည်။ကြေငြာချက်ပါ အမှတ်တံဆိပ်များသည် အမှတ်တံဆိပ်မှတ်ပုံတင်လျှောက်ထားခြင်း ကနဦးလက်ခံသည့်ကာလ (soft opening) အတွင်း လျှောက်ထားခဲ့သည့် အမှတ်တံဆိပ်များ ဖြစ်ပြီး လုပ်ထုံးလုပ်နည်းအရ စစ်ဆေးရေးအရာရှိက ဥပဒေပုဒ်မ ၁၃ နှင့် ၁၇ တို့နှင့်အညီ စစ်ဆေးပြီးဖြစ်သော (formality checked) အမှတ်တံဆိပ်များဖြစ်သည်ကို လေ့လာတွေ့ရှိရသည်။

ကနဦးလက်ခံသည့်ကာလအတွင်းမှတ်ပုံတင်လျှောက်ထားခဲ့သည့် အမှတ်တံဆိပ်များ ဖြစ်သောကြောင့် ကြေညာချက်ပါ အမှတ်တံဆိပ်များအားလုံးသည် တူညီသော လျှောက်ထားချက်တင်သွင်းသည့်နေ့ (Application Date) ဖြစ်သော ၂၆ ဧပြီ ၂၀၂၃ ကိုရရှိကြသည်။ မူပိုင်ခွင့်ဦးစီးဌာနသည် ကနဦးလက်ခံသည့်ကာလကို အောက်တိုဘာ ၁ ရက် ၂၀၂၀တွင် စီးပွါးရေးနှင့် ကူးသန်းရောင်း ဝယ်ရေး ဝန်ကြီးဌာန၏ အမိန့်ကြေငြာစာ ၆၃/၂၀၂၀ ဖြင့် စတင်ခဲ့ပြီး ထိုကာလ အတွင်း ကုန်အမှတ်တံဆိပ်မူပိုင်ခွင့်ဥပဒေ အာဏာမတည်မီ နိုင်ငံတစ်ဝှမ်းရှိစာချုပ်စာတမ်းမှတ်ပုံတင်ရုံးများတွင် မှတ်ပုံတင်ထားသော အမှတ်တံဆိပ်များ (အမှတ်တံဆိပ်ပိုင်ရှင်ဖြစ်ကြောင်း မြွက်ဟကြေညာချက် ကို မှတ်ပုံတင်သွင်းထားသော အမှတ်တံဆိပ်များ) နှင့် အထက်ပါအတိုင်း မှတ်ပုံတင်ထားခြင်း မရှိသော်လည်း ပြည်တွင်းစျေးကွက်တွင် အမှန်တကယ် အသုံးပြုလျှက်ရှိသော အမှတ်တံဆိပ်များကို Electronic Filing စနစ် WIPO File Account ရရှိထားသော ကိုယ်စားလှယ် (Trademark Agent) တဆင့် လက်ခံခဲ့သည်။ WIPO File Account ရရှိထားသောကိုယ်စားလှယ် (Trademark Agent) များသည် မူပိုင်ခွင့်ဦးစီးဌာန (IPD) မှ ပို့ချသော ကိုယ်စားလှယ်သင်တန်း (Agent Training) တက်ရောက်အောင်မြင်ထားသူများဖြစ်ကြပါသည်။

ကုန်အမှတ်တံဆိပ်ပိုင်ရှင်များ၊ အကျိုးသက်ဆိုင်သူ stakeholders များ၊ အသင်းအဖွဲ့အစည်းအရုံးများ အနေဖြင့် မူပိုင်ခွင့်ဦးစီးဌာန၏ ထုတ်ပြန်ကြေငြာချက်များကို မျက်ချေမပျက် စောင့်ကြည့် ရန်လိုအပ်ပါသည်။ မူပိုင်ခွင့်ဦးစီဌာန အနေဖြင့် လူမှုကွန်ယက် (social media) မှ တဆင့် အချိန်နှင့် တပြေးညီ ကြေညာလျှက်ရှိသောကြောင့် သတင်းအချက်အလက် ရရှိရန်လွယ်ကူသည်ဟု ယူဆပါသည်။ ထို့ကြောင့် ထုတ်ပြန်ကြေညာချက်ပါ အမှတ်တံဆိပ်များကို စောင့်ကြည့်၍ မိမိ ပိုင်ဆိုင်သော (သို့မဟုတ်) အသုံးပြုလျှက်ရှိသော အမှတ်တံဆိပ်နှင့် ကြေညာချက်ပါ အမှတ်တံဆိပ် တစ်ခုခုသည် ထပ်တူ (သို့မဟုတ်) ဆင်တူယိုးမှား တူညီမှုရှိပါက သတ်မှတ်ကာလစည်းကမ်းသတ်အတွင်း လုပ်ထုံး လုပ်နည်းများနှင့် အညီ ကန့်ကွက်ခြင်းကို ဆောင်ရွက်ရန် အကြံပြုလိုပါသည်။

ကြေညာချက်ပါ အမှတ်တံဆိပ်အား ကန့်ကွက်လွှာတင်သွင်း ရမည့် နောက်ဆုံးနေ့ရက် (Deadline) မှာ ဇွန်လ (၃၀) ရက်နေ့ ၂၀၂၄ ဖြစ်ပါသည်။

Myanmar Intellectual Property Department released its inaugural trademark journal
On the first of May in the year 2024, the Myanmar Intellectual Property Department released its inaugural trademark journal. This journal contains an exhaustive list of 220 marks and serves as a crucial component in the trademark registration process. Each trademark is described in detail, including the owner's particulars, the class(es) of goods and services, and the local agent's contact information. These trademarks are classified under the globally recognized Nice Classification system, ensuring ease of accessibility for the public.

It is important to emphasize that while publication in the journal is a necessary step, it does not guarantee a trademark's registration. Rather, it makes the trademark available for opposition by third parties, as stipulated in Section 26 of the Trademark Law. Any third party may object to the proposed trademark's registration within 60 days of the journal's publication. To do so, they must file an opposition with the application form TM-8, pay the prescribed fee, and state any grounds mentioned in Sections 13 and 14 of the Trademark Law. If no objections are raised within the period of 60 days the trademark will receive final approval from the department for valid registration within the Myanmar jurisdiction.

Consequently, the publication of a trademark in the journal provides the public with an equitable opportunity to scrutinize and voice their disagreement with the trademark. This transparent and impartial process ensures the protection of intellectual property rights while promoting fair competition in the marketplace.
