Trademark Registration Procedure in Morocco
The procedure begins with the lodgement of an application at the Trademark Office, which depicts the mark, and specifies the relevant goods or services, for which registration is sought; according to the terms provided in the trademark law.
After your application is filed at the Trademark Office (Moroccan Industrial and Commercial Property Office (OMPIC); the applicant or his representative will be given a filing number and date to acknowledge that the application has been received. Thereafter, the trademark office will review the application and examined the same on the basis of absolute grounds and relative grounds. The registrar orders to search within the trademarks records to make sure that there is no identical or similar mark to the degree that would result in a likelihood of confusion i.e. to ensure that no prior identical or similar trademark has been registered.
In case of refusal, the Registrar shall notify the applicant of the grounds, of his decision and of the relevant facts in writing. A time limit of 15 days from the date of receipt of notification of provisional refusal is giving to the applicant to comply with the limitations imposed by Registrar or appeal the decision.
Trademark applications accepted by the Registrar are published in the Official Gazette TMO. There is sixty (60) days period open for filing an opposition. If no opposition is filed against your application, or if opposition is unsuccessful, your trademark will be registered, and the relevant certificate of registration will be issued.
