Trademark Opposition in Morocco

Trademark applications accepted by the Registrar are published in the Official Gazette TMO. There is a 60 day period open for filing an opposition by any interested party. An opposition to the registration of a trademark should be prosecuted before the Trademark Office (OMPIC) by an authorized agent or the proprietors themselves within the prescribed period as from the date of publication. This period is not extendable. The opponent has to prove that there are valid grounds as to why the trademark applicant is not entitled under law to register or to continue holding the mark.

The Opposition Committee shall send a copy of the notice of opposition to the applicant or his agent who shall, within 15 days from the receipt thereof to send to the Registrar a written Counter-Statement of the grounds on which he relies for his application, and, if he does not do so, he shall be deemed to have abandoned his application.

The defence usually consists of a number of simple denials of the notice of opposition. If they submit a counter-statement to the opposition during the legal term the Opposition Committee at Trademarks Office (OMPIC) will examine it formally and substantially.

The Opponent and Defendant party shall have the right to appeal the Opposition Committee’s decision before the Appeal Committee at the Trademark Office (OMPIC) within 15 days from the date of the opposition decision. Appeal Committee’s decision can be appealed before of the Trade Court of Appeal of Casablanca and thereafter the Supreme Court within the time frame of 15 days from the date of the decision; otherwise the decision will become final.

Trademark Registration Procedure in Morocco

The procedure begins with the lodgement of an application at the Trademark Office, which depicts the mark, and specifies the relevant goods or services, for which registration is sought; according to the terms provided in the trademark law.

After your application is filed at the Trademark Office (Moroccan Industrial and Commercial Property Office (OMPIC); the applicant or his representative will be given a filing number and date to acknowledge that the application has been received. Thereafter, the trademark office will review the application and examined the same on the basis of absolute grounds and relative grounds. The registrar orders to search within the trademarks records to make sure that there is no identical or similar mark to the degree that would result in a likelihood of confusion i.e. to ensure that no prior identical or similar trademark has been registered.

In case of refusal, the Registrar shall notify the applicant of the grounds, of his decision and of the relevant facts in writing. A time limit of 15 days from the date of receipt of notification of provisional refusal is giving to the applicant to comply with the limitations imposed by Registrar or appeal the decision.

Trademark applications accepted by the Registrar are published in the Official Gazette TMO. There is sixty (60) days period open for filing an opposition. If no opposition is filed against your application, or if opposition is unsuccessful, your trademark will be registered, and the relevant certificate of registration will be issued.
