If you are interested in obtaining Lithuanian citizenship by descent but do not have your ancestor's Lithuanian birth certificate, rest assured that you are still eligible to initiate the process and obtain Lithuanian citizenship by descent.

The essential condition to apply for Lithuanian citizenship by descent is to know that at least one of your parents, grandparents or great-grandparents was from Lithuania. Ideally, you would also need to know your Lithuanian ancestor's full name, date and place of birth, approximate year of emigration, and his/her parents' names. In cases where you do not have this information, do not worry as it is acceptable. IN JURE Law Firm has access to various archival funds in Lithuania and foreign countries and conducts archival searches in archival library reading rooms to ensure a complete search and investigation.

In most cases, we can find either birth certificates or birth records in archives by ourselves. However, if we do not find them, there are other types of evidence that your Lithuanian ancestor was holding Lithuanian citizenship. The birth certificate is not the only document and is certainly not a key to a successful outcome.

Gathering all the required proof to build your application for Lithuanian citizenship by descent is a complex process, and consulting Lithuanian archives is often not enough. This is especially true for those whose ancestors changed their names and dates of birth upon arrival in their country of emigration.

The amazing thing about reinstating your Lithuanian citizenship is a gift for future generations as you pass on Lithuanian citizenship to your children by the birth right, your children pass it on to theirs, etc. Lithuanian citizenship is for a lifetime.

There are two main aspects one must understand regarding your children's‘ eligibility for Lithuanian citizenship by descent.

Consider the fact if your child is born BEFORE you have reinstated your Lithuanian citizenship or AFTER.

If your child was born BEFORE you were granted with Lithuanian citizenship, unfortunately your child will not become Lithuanian citizen automatically. That means that your child must be no further than the third generation to a Lithuanian ancestor and follow the entire reinstatement procedure as you did. The advantage for your child is that archival investigation has already been done and all the ancestral documents are in place. This will save time and shorten the procedure at the end of the day.

If your child was born AFTER you were granted with Lithuanian citizenship, your child becomes Lithuanian citizen by the birth right, i.e. you automatically pass on your Lithuanian citizenship to your child. There are absolutely no eligibility criteria to meet. All you have to do is to register your child‘s birth in Lithuanian civic registry before you order a passport for your child. What information and documents are required from the applicant❓

✔️ To initiate the procedure of ancestral citizenship restoration we would require to provide us with information about one‘s Lithuanian ancestor:
• His/her full name in Your country and Lithuania;
• His/her date of birth;
• Place where he/she lived in Lithuania;
• His/her parents and siblings.

This might seem like a lot of information, especially if all you know at the moment is that your ancestor came from Lithuania. Do not be frightened of the fact that you do not know all the information required. We will guide you in the process and share our know-how solutions to hook on something in archival investigation.

❗️ Note, that there is no need for you to have Lithuanian documents. Availability of such supporting documents might be helpful but not necessary.

✔️ To start the procedure we would ask you to provide us with the list of family members who are keen to proceed for the reinstatement of Lithuanian Citizenship along with simple scan copies of passports, postal addresses, contact cell phone numbers.

Later, during the process we would require unabridged (i.e. full) birth certificates (UBC) for each applicant including your mother‘s or father‘s who is a link to your ancestor. If you do not have UBC at your possession, you can apply for it in HAD. It takes approx. 6 months to receive it.

Very likely that we would ask from you to source out either Death Notice or Naturalization certificate for your ancestor from state archives.

✔️ The Republic of Lithuania permits dual citizenship in exceptional cases. An ancestral Lithuanian citizenship is one of the exceptional cases in which the reinstatement of one’s Lithuanian citizenship is possible without losing existing citizenship status.

What are the eligibility criteria for restoring citizenship by descent?

You can get Lithuanian citizenship if one of your parents, grandparents or great-grandparents had Lithuanian citizenship, i.e. three generations back.

There are several eligibility criteria. However in my practice the most common eligibility criteria one must fall in is as follows:

At least one of your parents, grandparents or great-grandparents were citizens of the Republic of Lithuania, which existed from 1918 to 1940, i.e. left Lithuania after 1918. In other words – Lithuania until 1915 (since 1795) was occupied / part of Russian Empire; then 1915-1918 during the IWW occupied by Germany; thus only people who still lived in Lithuania after 1918 became citizens of Lithuania.

There are a number of factors that might initially seem a hindrance to your application, deeming you ineligible. However, only an experienced attorney is able to assess your circumstances correctly to determine whether you are eligible for reinstatement of citizenship.

What if I do not possess any proof that my ancestor was citizen of Lithuania prior to the World War II❓

✔️ In nine out of 10 cases, my clients do not have documents proving that their ancestor was from Lithuania. This is completely normal, and definitely not a problem. Knowing that at least one of your parents, grandparents, or great-grandparents was from Lithuania is the only essential condition to successfully initiate the process. The rest is our job. We have extensive experience working with various archives in Lithuania and were able to find some proof of citizenship in the most complicated cases. We can read in all languages used at that time in Lithuania.

What if my ancestor has changed his/her name and it is not the same as in his Lithuanian documents❓

✔️ It is a usual case. We will address this issue with historians and Yiddish language specialists and will prepare needed paperwork.
