A Judge in Scotland, Lord Braid has ordered James Finlay Kenya Ltd (JFK) to stop a case it filed in a Kenyan court to block another suit in the United Kingdom by the Kenyan tea workers. Lord Braid, on Monday ruled that JFK that owns thousands of acres of tea bushes in Kericho County, stops the proceedings in the Employment and Labour Relation Court in Nairobi to allow a case filed by some 1,044 former and current employees in Scotland to continue. RKO Advocates LLP led by Kenyan born British Lawyer Ronald Onyango acts for these clients in the Scottish case alongside Thompsons Solicitors Scotland who complained that harsh and exploitative working conditions on a Scottish-run tea plantation caused them permanent physical and psychological damages.

In the court of session proceedings held via a video link, Lord Braid acknowledged that the lawyers representing the workers had put forward a “strong prima facie case” that the action taken by JFK in Kenya was “vexatious and oppressive.” JFK is an Aberdeen multinational with estates in Kericho which stretch across 10,117 hectares (25,000 acres) and is one of the world’s largest supplier of tea and coffee and includes key high street brands such as Tesco, Sainsbury’s, the Co-op, Betty and Taylors and Starbucks in UK among its customers.

James Finlay (Kenya) Ltd, an Aberdeen based giant multinational operating in Kenya and stocks major UK Supermarkets brands including Tesco, Sainsbury’s, Starbucks, The Co-op and Betty & Taylor’s Group with their tea, coffee and botanical products has sued 1,044 Kenyan tea workers in the Kenya courts with costs and other demands after they had complained to the UK courts in Scotland concerning an oppressive, exploitative and poor working conditions at Finlay Kenyan tea plantations. They claim that working at the plantations resulted into serious and permanent injures to their spines and psychological injuries. The tea workers are supported by a local NGO Justice and Environment Foundation. The suit on behalf of the tea workers has been brought by a human rights focused Nakuru based law firm in Kenya, Ronald K Onyango Advocates LLP (‘RKO’) working with an established UK trade Union Law firm, Thompsons Solicitors Scotland and Ozon Solicitors. The Lawyers represent over 1,000 Kenyan tea plantation workers at the Scottish court against the giant multinational, James Finlay (Kenya) Ltd (‘Finlay’).

Kenyan Tea Workers obtain court’s protection in Scotland against threats, intimidation, destruction of medical and employment records by James Finlay (Kenya) Ltd. Kenyan tea workers by multinationals operating in Kenya. The undertaking given to the Court by Finlay's Directors will expire upon the conclusion of the Group Proceedings with Court Reference CP3/21. The Group Litigation against the Scottish based tea company operating in Kenya has approximately 1,700 tea workers who have complained about poor working conditions and suffered physical and psychological injuries. RKO Advocates LLP in Kenya is working with two UK law firms; Thompsons Solicitors and Ozon Solicitors in the case.

Kenyan tea workers case set precedent as they are allowed to sue James Finlay in Scottish Court.

Ronald K Onyango Advocates LLP (“RKO”) in collaboration with Thompsons Solicitors Scotland, were in court on 27 January 2022 before Lord Weir, representing over 718 tea workers in an application for Group Proceedings in Scotland. The case lodged on 29th September 2021 against James Finlay (Kenya) Ltd for financial compensation and medical rehabilitation of its former and current employees is now set to increase to thousands of other tea workers touching on human rights complaints and conditions akin to modern day slavery. Patrick McGuire, a partner at Thompsons Solicitors which represents the Kenyan workers, said: "This is an extremely important day in the long fight for justice for the Kenyan tea workers”. Ronald Onyango, Managing Partner at RKO Advocates said that ‘there was a need to bring to an end the entrenched oppressive, inhumane and degrading treatment of Kenyan tea workers by multinationals operating in Kenya.”
