The Transition Implementation Committee on Pauper Briefs and Pro Bono Services has commenced public participation and sensitization ahead of the full transfer of the scheme from the Judiciary to the National Legal Aid Service (NLAS), anticipated in January 2027.

The forums kicked off yesterday at the Nairobi Branch, with the participation of Branch Council Members Netia Opisa, Ivysharon Kirui and David Mwangi, alongside practising advocates, representatives of the Judiciary, NLAS , representatives from the Civil Society , the public and the Law Society of Kenya.

Participants from Transition Implementation Committee; included Hon. Pauline Mbulikah, Chairperson; Ms. Teresia Wavinya, Vice President of the Law Society of Kenya; Ms. Fresiah Githumbi, Acting Chief Executive Officer of NLAS; Mr. Wycliffe Oyoo, LSK Nairobi Representative; and other members of the Committee.

The discussions addressed the rationale for the transition, NLAS’s mandate, anticipated changes in service delivery, and stakeholders’ responsibilities during and after the handover.

In her opening remarks, LSK Vice President Teresia Wavinya emphasized that continuity of legal representation and the welfare of advocates must remain central to the transition. She called for clear procedures for administering and allocating briefs, uninterrupted handling of ongoing matters, and timely access to information for advocates and beneficiaries.

The Vice President further underscored the need to settle outstanding claims, establish a transparent and predictable payment framework, and provide commensurate remuneration for advocates undertaking briefs under the scheme.

She also reiterated concerns regarding the proposed accreditation fees and an additional disciplinary framework for participating advocates. She noted that these matters had previously been raised before the Committee and it was resolved to be omitted necessitating an amendment to the Legal Aid Act.

Over the next three weeks, the Committee will visit the other LSK branches to sensitize members, receive their views and address practical concerns ahead of implementation.

In conclusion of the Chapter Visit to Thika Chapter, the Branch Council paid courtesy calls on the Thika High Court, Thika Magistrate Court and Thika Land Registry.

At the Thika Land Registry, the Council met with the Deputy Land Registrar, Mr. Ngila, and other members of the Registry staff. The Council and the Registry team held discussions on various issues affecting conveyancing practitioners at the Registry. Key issues raised included the infiltration of the Registry by brokers and concerns regarding high valuation amounts.

At the Thika High Court and Thika Magistrate Court, the Council was hosted by the Head of Station, Hon. Lucy Mutai, who was also representing the Presiding Judge of the Thika High Court. The courtesy call was attended by Hon. Maureen Nabibya, Hon. Caroline Kimathi, Branch Chairperson Eric Kivuva, Council Member and Kiambu Representative Philip Gacheru, Council Members Faith Opisa Netia, David Mwangi and Ivysharon Kirui, Thika Chapter Chairperson Kanyi Kiruchi, and members of the Branch Secretariat.

The deliberations focused on the challenges affecting the practice of law and service delivery at the Courts. The Head of Station highlighted key challenges, including an insufficient number of judicial officers, inadequate modern laptops and other equipment, as well as limited office and court space.

The Council and the Thika Chapter Chairperson commended the judicial officers and staff for their commitment to service delivery despite the challenges facing the Courts. The Council further reaffirmed its commitment to working collaboratively with the Judiciary and other stakeholders to advocate for improvements that would enhance service delivery and create a better practice environment for advocates and litigants at the Thika Courts.

The Council further paid a courtesy call on the Kamwangi Magistrate Court.

The Council was hosted by Hon. Cedric Omukhulu, on behalf of the Head of Station, Hon. Wangechi Ngumi. The courtesy call was also attended by Branch Chairperson, Eric Kivuva; Council Member and Kiambu Representative, Philip Gacheru; Council Members Faith Opisa Netia, David Mwangi and Ivysharon Kirui; Thika Chapter Chairperson, Kanyi Kiruchi; members of the Kamwangi Court staff; and members of the Branch Secretariat.

Hon. Omukhulu informed the Branch and Thika Chapter leadership that, being a relatively new Court, there were no major challenges requiring attention at the moment. He, however, noted that poor internet connectivity remained an issue, occasionally causing disruptions during virtual hearings.

Council member and Kiambu representative, Philip Gacheru, and the Thika Chapter Chairperson, Kanyi Kiruchi, commended the Court for its efficiency, noting that there had been no complaints raised by advocates regarding the Court’s operations.

The Branch Council thanked Hon. Omukhulu and the members of the Court staff for their warm welcome and for the fruitful engagement.

The Council also paid a courtesy call on the Gatundu Magistrate Court.

The Council was hosted by the Head of Station, Hon. Daniel N. Musyoka (CM). Also in attendance were Hon. Rachel Kiema; Branch Chairperson, Eric Kivuva; Branch Vice-Chairperson, Wilberforce Akello; Council Member and Kiambu Representative, Philip Gacheru; Council Members Faith Opisa Netia, David Mwangi and Ivysharon Kirui; Thika Chapter Chairperson, Kanyi Kiruchi; members of the Gatundu Court staff; and members of the Branch Secretariat.

In his remarks, the Branch Chairperson commended the Head of Station for the exemplary efficiency demonstrated at the Court. The Thika Chapter Chairperson, while presenting concerns raised by advocates practising at the Gatundu Magistrate Court, echoed the Branch Chairperson’s sentiments, noting that the Court had generally been rated by advocates as one of the most efficient.

He, however, highlighted some areas requiring attention, including delays in the typing of proceedings, delays in the issuance of decrees, and delays in the uploading of judgments on the CTS.

The Head of Station appreciated the feedback from the Bar and committed to ensuring improvement in the areas highlighted. He further expressed appreciation for the courtesy call by the Council, noting that the engagement had been productive.

As part of the Chapter Visit to Ruiru Chapter, the Branch Council paid a courtesy call on the Ruiru Magistrate Court.

The Council was hosted by the Head of Station, Hon. Beatrice Kimemia (CM). The visit was attended by Hon. Grace Nteere, Hon. Christine Asuna, Hon. Jacklyne Tawai and Hon. Charles Mwaniki; Branch Chairperson Eric Kivuva; Branch Vice-Chairperson Wilberforce Akello; Council Member and Kiambu Representative Philip Gacheru; Council Members Faith Opisa Netia, David Mwangi and Ivysharon Kirui; Thika Chapter Chairperson Kanyi Kiruchi; members of the Court staff; members of the Branch Secretariat; and students from various law schools undertaking internships at the Court.

The deliberations focused on challenges affecting the administration of justice and the practice of law at the Court. The Court highlighted several infrastructural and operational challenges, including inadequate space and infrastructure, the heightened risk of flooding in the registries where court records are kept during heavy rains, as experienced in previous rainy seasons, and staff shortages.

The Thika Chapter Chairperson, Mr. Kanyi Kiruchi, also presented concerns raised by advocates practising at the Ruiru Court, particularly delays in the issuance of decrees and delivery of judgments and rulings.

The Branch Chairperson and the Thika Chapter Chairperson commended the judicial officers and staff at the Court for the improvements made in service delivery. They reaffirmed the Branch's commitment to supporting the Court in addressing the challenges raised and in promoting the expeditious resolution of matters affecting court users and practitioners.

Hon. Beatrice Kimemia (CM) appreciated the engagement and committed to working towards addressing and improving the areas highlighted by the Thika Chapter Chairperson.

The courtesy call provided an important platform for constructive engagement between the Bar and the Bench, with a shared commitment to improving access to justice and service delivery at the Ruiru Magistrate Court.

*BRANCH COUNCIL COURTESY CALL TO RUIRU LAND REGISTRY*

Today, the Branch Council conducted a Chapter Visit to the Thika Chapter. As part of the visit, the Council paid a courtesy call to the Ruiru Land Registry.

The Council was hosted by Mr. Robert Mugendi Mbuba, the Land Registrar in charge of the Ruiru Land Registry. Also in attendance were the Branch Chairperson, Eric Kivuva; Branch Vice-Chairperson, Wilberforce Akello; Council Member and Kiambu Representative, Philip Gacheru; Council Members Faith Opisa Netia, David Mwangi and Ivysharon Kirui; Thika Chapter Chairperson, Mr. Kanyi Kiruchi; registrars, surveyors and other members of the Ruiru Land Registry staff; and members of the Branch Secretariat.

The courtesy call provided an opportunity for the Branch Council and the Registry team to engage extensively on the challenges facing the Registry, concerns raised by conveyancing advocates within the Thika Chapter, and areas where service delivery could be further improved.

The Branch Council and the Thika Chapter leadership commended the Registry team for the work they continue to undertake, noting that feedback from conveyancing advocates regarding service delivery at the Registry indicated general satisfaction with the manner in which matters were being handled.

The Branch Council extends its appreciation to the Land Registrar and the entire Registry team for the warm reception, constructive engagement and productive discussions. The Council looks forward to continued collaboration with the Ruiru Land Registry in addressing challenges affecting conveyancing practice and enhancing service delivery to members of the public and the legal profession.
