Understanding the probate process is essential to ensure that a deceased personโ€™s wishes are honoured and their estate is administered lawfully and efficiently.

A key step in this process is obtaining a Grant of Probate, a legal document issued by the High Court that authorizes the executor named in the will to manage and distribute the deceasedโ€™s estate according to their wishes.

However, before a Grant of Probate is issued, the Court must confirm that the will meets the legal requirements and that the deceased had the capacity to make it. The process also involves filing a formal petition, providing an inventory of assets and liabilities, and publishing the application in the Kenya Gazette to allow for any objections.

From 1st January 2026, filing tax returns in Kenya will change. The Kenya Revenue Authority (KRA) will automatically verify your declared income and expenses through the iTax system using three key records:

If what you declare doesnโ€™t match these records, your return could be flagged or even rejected by the system.

This means handwritten receipts, generic receipts, or invoices issued outside the electronic system may no longer support your tax deductions, even where the transaction actually took place.
