MNO Advocates LLP is pleased to have successfully represented the Petitioner in the above constitutional petition challenging the continued enforcement of the purported sh**ha ban in Kenya.

The High Court this morning granted all the declaratory reliefs sought and issued orders of certiorari, including:

βœ”οΈ Declaring the Public Health (Control of Sh**ha Smoking) Rules, 2017 unconstitutional and unenforceable.
βœ”οΈ Declaring that there is no lawful basis for the continued enforcement of the purported sh**ha ban.
βœ”οΈ Declaring the impugned press releases and directives issued by the Ministry of Health on sh**ha ban unconstitutional and unlawful.
βœ”οΈ Quashing the impugned press releases and administrative directives through orders of certiorari.

This judgment is an important reaffirmation of constitutional governance: public authorities cannot create or enforce legal obligations through press statements or administrative directives where no valid legal framework exists. The rule of law demands that executive action must always be anchored in legislation and the Constitution.
