In a significant judgment delivered by the Environment and Land Court at Kwale in ELC Case No. ELCLC/E026/2024, the Court sent a clear and unequivocal message: an intimate relationship is not a licence to misappropriate your partner's money or property.
Our client had invested millions of shillings in what he believed was a shared future. Instead, trust was betrayed, property was secretly registered in the other party's sole name, and substantial sums meant for development were diverted.
We took the matter to court.
The Court found that the registration of the property had been procured through fraud and misrepresentation, ordered rectification of the land register, restored our client's proprietary rights, directed a refund of over Kshs. 15.6 million, together with interest, and awarded costs.
This decision is bigger than one dispute.
It reinforces an important legal principle: the law protects trust, but it will not protect those who abuse it. Whether the deception occurs in a commercial transaction, a friendship, or a romantic relationship, the courts will look beyond emotions and enforce legal rights.
