Providing for a child is a shared parental responsibility.

Even when parents separate or are no longer in a relationship, their responsibility towards their child does not simply disappear. What matters most is ensuring that the child’s needs, welfare, and future remain protected.

Child maintenance can go beyond regular financial payments. It may include essential needs such as:

✔️ Food and basic necessities
✔️ Education
✔️ Medical care
✔️ Clothing
✔️ Shelter
✔️ Other needs necessary for the child’s welfare

Where parents are unable to agree, the court may make a maintenance order based on factors including the needs of the child, the circumstances of each parent, and the ability of the person liable to maintain the child.

Most importantly, the best interests and welfare of the child should always come first.

Child maintenance is not about one parent “paying” the other. It is about ensuring that a child’s needs are met and that both parents play their part in providing for their child.

Under the Children Act, 2022, both parents have a joint duty and responsibility to maintain their child, whether or not they are married to each other.

Child maintenance may cover important needs such as:

✔️ Basic nutrition
✔️ Shelter
✔️ Clothing
✔️ Medical care
✔️ Education
✔️ Water and sanitation
✔️ Guidance and general welfare

Where parents cannot agree, a court may make a maintenance order and determine the appropriate provision based on the circumstances of the child and the parties.

Most importantly, the best interests and welfare of the child should come first.

A relationship between parents may end, but parental responsibility does not end with separation.

👨‍👩‍👧‍👦 LET'S TALK CHILD MAINTENANCE

Last time, we explored child custody. Today, let's talk about another important aspect of family law: child maintenance.

Child maintenance is not simply about making a monthly payment. It is about ensuring that a child's essential needs are adequately provided for.

Under Kenya's Children Act, both parents have a joint duty and responsibility to maintain their child, whether or not they are married to each other. This responsibility includes providing for needs such as:

✔️ Basic nutrition
✔️ Shelter
✔️ Clothing
✔️ Medical care
✔️ Education
✔️ Water and sanitation
✔️ General guidance and welfare

A court may also make a maintenance order and determine appropriate financial provision based on the circumstances of the child and the parties involved. Such provision may be made through periodic payments or a lump sum, depending on what the court considers appropriate.

Most importantly, child maintenance is about the child's welfare—not about winning or losing a dispute between parents.

Parents may disagree, relationships may end, and circumstances may change, but the responsibility to support a child remains important.

When parents separate, one of the most important questions is often: Who gets custody of the child?
But custody is not always as simple as deciding where a child will live.
There are two important aspects to understand:

🔹 LEGAL CUSTODY
This concerns the authority to participate in major decisions affecting the child, including matters such as education, healthcare, religion, and general welfare.

🔹 ACTUAL / PHYSICAL CUSTODY
This concerns where the child lives and who has the day-to-day care and control of the child.

⚖️ GRANT OF PROBATE: WHAT DOES IT MEAN?

When a person dies leaving a valid will, the court may issue a Grant of Probate to the executor or executors named in that will.

But what exactly does this mean?

A Grant of Probate provides the executor with the legal authority to administer the deceased's estate. It is an important step in ensuring that the wishes expressed in the will are properly followed.

Why is a Grant of Probate important?

✔️ It confirms the validity of the will.
✔️ It gives the executor legal authority to administer the estate.
✔️ It provides a legal framework for dealing with the deceased's assets and liabilities.
✔️ It helps ensure the wishes in the will are properly implemented.

It is also important to remember that obtaining a Grant of Probate is not the same as immediately distributing the estate. The succession process has further legal steps that must be followed.
