What is a castell? The Catalonian tradition of creating human towers called castells stretches back centuries and has evolved into a competitive sport. Hundreds of people come together to act as building blocks for these temporary monuments to teamwork and cooperation. On 16 November 2010, castells were declared by UNESCO to be amongst the Masterpieces of the Oral and Intangible Heritage of Humanity. 👏 🥁 Our Managing Advocate, Mercy Kareithi is honoured to serve, for the second year in a row, as a panelist for the selection of the Courtroom Mail 100 African female lawyers, 2026. Courtroom Mail is an annual list of outstanding female lawyers of African descent who have made a remarkable impact as Superheroes, Heroes, Influencers and Disruptors (SHID). It is published by Courtroom Mail every 8th of March to commemorate International Women’s Day (IWD).

⚖️ 🌍 The pledge was to actively participate in the structured selection with objectivity, truth and independence, within the panel’s parameters. 🙋🏽 Happy end of the month, February. May we dive into matters carbon markets?

⏳ On 17th February 2026, the Ministry of Environment Climate Change and Forestry officially launched the Kenya National Carbon Registry (KNCR). The registry is managed by the National Environment Management Authority (NEMA) as the designated national authority (DNA) under the Climate Change (Amendment) Act 2023. It serves as the digital record of Kenya’s carbon market. This shifts Kenya from relying on international standards to a localised, home-grown central platform for validating and tracking carbon projects.

🥅 ⚙️ The primary goals include integrity, sovereignty, and compliance with the Paris Agreement. The registration process involves submitting a concept note, obtaining environmental and social impact assessment (ESIA) clearance, community development agreements (CDA), project validation report and a letter of approval.

CHILDREN, CCIS AND THE LAW

How do we protect our children in the changing times?
The Children’s Act, 2022 mandates a shift from charitable children institutions (CCIs) to family-based care.

Section 67 ensures enforcement when the child has no immediate access to parental care by the child’s parent, guardian or relative, if any or no alternative family-based placement, is for the time being available to the child; or the usual place of abode or home is not conducive to the well-being of the child. By 2026, the government is strictly enforcing the rule that children should not stay in an institution for more than three years.

The law now prioritizes Foster Care and Kafaalah (for Muslims) over keeping children in homes. This is a major win for the Muslim community. It provides a formal legal structure for children to be cared for under Islamic law as an alternative to traditional adoption, ensuring these children have legal recognition and protection.

With the implementation phase closing in (2022-2032) with hopes to achieve major milestones, how do we ensure proper implementation of the Children's Act and proper protection of our future generations?

Mob justice 🤼🤹 in Malili, Makueni County (https://www.the-star.co.ke/news/2026-01-31-three-men-lynched-in-malili-makueni )

The law⚖️: In modern Kenya, mob justice has become a quick response to robbery and other crimes. Due to lack of faith in the justice system, people often take the law into their own hands. Recently in Malili area, Makueni County, three men were lynched and their lorry burned over allegations of livestock theft. This raises serious concerns, as anger does not justify breaking the law. Article 26 of the Constitution guarantees everyone the right to life. Article 28 protects inherent dignity and respect, while Article 50 ensures the right to a fair hearing and the presumption of innocence until proven guilty.

Food for thought🤔: Mob justice amounts to murder, a crime under Section 234 of the Penal Code. Section 21 of the Penal Code is clear that common intention makes every participant guilty of a felony and liable to life imprisonment. Although no single person may deliver the fatal blow, the law holds all participants guilty. The strong social code of silence complicates mob justice cases by discouraging witnesses. This leaves both victims—of the initial crime and of the lynching—vulnerable.

Question⁉️: How do we bridge the gap between communal frustration from unaddressed crime and the modern justice system? Is the law working in Kenya? Where is the balance?

ENTERTAINMENT & THE LAW IN KENYA

There is an animated debate about Kenya's proof of concept: global streamer IShowSpeed's visit to Kenya. Last weekend, popular YouTube streamer IShowSpeed visited Kenya. He played rugby with the national team; cooked ugali and chapati with locals. His stream attracted 48 million viewers, placing Kenya on the global map. This interaction proved that Kenya is ready for the international creator market.

From a legal perspective, this visit highlights our laws, including:

1. The Digital Nomads Permit, which allows freelancers and streamers to access the country if they meet the requirements, setting the pace for other creators.
2. The Creative Economy Support Bill 2024. The visit enabled interaction with local creators such as Bradley (Gen Z Goliath) and Colloblue (TikTok dancer), among others, giving them greater visibility.

The dilemma is that this global event was a huge success but has raised various questions such as:
1. How are creators protected during collaborations?
2. Are our IP laws agile enough for live streaming revenue?
3. What about probate(succession) for the perpetual revenue when the inevitable happens?
4. How do international creators navigate Kenya's visa-free but permit-regulated environment?

Staying informed on these regulations is the first step toward a sustainable creative future in Kenya. Let us engage.
