The Court of Appeal has held that the mandatory/minimum sentences under Sexual Offenses Act are unconstitutional. The Court stated that Parliament in enacting that law purported to usurp the Judicial function of courts.

The Meru High Court has declared section 35 (1) (b) and 36 (1) (b) of the Succession Act unconstitutional for denying widows the right to inherited property when they remarry.

The cited sections denies a widow the right to the deceased husband's estate if she remarries.
