【How to Do a Recognition of Foreign Divorce in the Philippines】

Hello.
My name is Asami Okawa.
I am a certified administrative procedures specialist (Gyoseishoshi).

Many of my clients are Filipino people.
Most of them live in Japan.

Recently, especially since around 2020,
I have received many questions from people who say,
“I got divorced in Japan, and I want the Philippines to recognize my divorce too.”

Today, I will explain in a simple way
about the court procedure in the Philippines called
“Recognition of Foreign Divorce.”

In the Philippines, there is no divorce system in general.
So, if two Filipinos get married,
it is not easy for them to get divorced,
even if their relationship becomes very bad.

For example,
even if one spouse had an affair,
did not give money for living expenses,
or used violence,
they may still not be able to divorce
like people can in Japan.

However, if one spouse is a foreigner
and the divorce was legally completed in that foreign country,
there is a procedure in the Philippine court
to recognize that divorce.

But even if the divorce was completed in Japan,
it does not automatically mean
that the person is divorced in the Philippines.

So, it is necessary to file a case in the Philippine court
and ask the court to recognize
the divorce that happened in a foreign country.

Then, how does the process work?

First, you need to find a lawyer in the Philippines.
Then, you make a contract with that lawyer.

After that, you collect the necessary documents in Japan.
Usually, the Philippine lawyer will give you a list and say,
“Please prepare these documents.”

In my experience,
there are mainly four documents needed on the Japan side.

The first is the former husband’s family register.
We call "Koseki tohon".
It must show both the marriage and the divorce.

The second is a Certificate of Acceptance of Divorce.
We call "Rikon todoke jyuri shouemisho".
This is a document from the city hall
which proves that the divorce paper was properly accepted.

The third is a Certified true copy of notification of divorce.
We call "Rikon todoke kisai jikou shouemisho".
This document proves the contents of the divorce paper.
It is usually a copy of the divorce paper
with official certification from the city hall or legal office.

The fourth is a document showing
that Japan has a legal divorce system.
For this, we may use a copy of the Civil Code
obtained from the National Diet Library.

Also, all of these documents need English translation.

For the English translations,
we get notarization at a notary public office.
After that, we get an Apostille
from the Ministry of Foreign Affairs.

Then, we send these completed documents
to the lawyer in the Philippines.
The Philippine lawyer will use them
to continue the court case.

This procedure is very important,
but there are many documents to collect,
and the contents are a little difficult.

その多くは、日本に住んでいるフィリピンの方です。

最近、特に2020年ごろから、
「日本で離婚したあと、フィリピンでもその離婚を認めてもらいたい」
という相談がとても増えています。

今日は、フィリピンで行う
「外国離婚の承認裁判」
について、できるだけ簡単に説明します。

この手続きは、
「リコグニション」
と呼ばれることもあります。

フィリピンでは、原則として、離婚の制度がありません。
そのため、フィリピン人どうしが結婚した場合、
たとえ夫婦の関係が悪くなっても、簡単に離婚することはできません。

たとえば、
相手が浮気をした、
生活費を入れてくれない、
暴力があった、
このようなことがあっても、
日本のように離婚できません。

ですが、相手が外国(日本)人で、その外国(日本)で正式に離婚している場合は、
フィリピンの裁判所でその離婚を認めてもらえる手続きがあります。

ただし、日本で離婚しただけでは、
フィリピンで自動的に「離婚したこと」にはなりません。

そのため、フィリピンの裁判所で、
「外国で離婚したことを認めてください」
という裁判をする必要があります。

では、どんな流れで進めるのでしょうか。

まず最初に、フィリピンの弁護士を探します。
そして、その弁護士と契約します。

そのあと、日本で必要な書類を集めます。
ふつうは、フィリピンの弁護士から
「この書類を用意してください」
という案内があります。

私の経験では、日本側で必要になる書類は、
主に4つです。

1つ目は、元ご主人の戸籍謄本です。
そこに、結婚と離婚のことが書かれている必要があります。

2つ目は、離婚届受理証明書です。
これは、市役所が
「離婚届をきちんと受け取りました」
と証明する書類です。

3つ目は、離婚届記載事項証明書です。
これは、出した離婚届の内容を証明する書類です。
離婚届のコピーに、役所などの証明がついたものです。

4つ目は、日本には離婚という制度があることを示す資料です。
この資料として、国会図書館から取得した民法の書類などを使うことがあります。

そして、これらの書類には、英語の翻訳も必要になります。

この英語の翻訳については、公証役場で認証を受けます。
そのあと、外務省でアポスティーユという認証をつけます。

この手続きが終わった書類を、フィリピンの弁護士へ送ります。
フィリピンの弁護士は、その書類を使って裁判を進めます。

この手続きはとても大切ですが、
集める書類が多く、内容も少し難しいです。
