Thursday, July 22, 2021 to Sunday, July 25, 2021

due to the national holidays related to Tokyo 2020 Olympic games. Any official deadlines falling within this period will be automatically extended to the next working day, Monday, July 26, 2021.

本年も、中小企業を対象にした外国出願費用の助成（中小企業等外国出願支援事業）の受付がジェトロで開始されます。申込期間は来週月曜の6/21から7/21までの1ヶ月間です。外国で知的財産に関する出願（特許、実用新案、意匠、商標、国内出願と同内容である出願）について、最大でかかる費用の半額の助成が受けられます。対象となる出願は来年1月までに出願手続が完了している必要があります。
外国出願の予定がある場合是非この助成制度の活用をご検討ください。

3月にご紹介させて頂きました特許法等の改正案が本日参議院にて可決され成立しました。

（1）手続のデジタル化の整備
（2）デジタル化進展に伴う権利保護の見直し
　・個人使用目的の模倣品輸入への対応
　・手続ミスにより消滅した権利を回復できる要件の緩和
（3）知的財産制度の基盤の強化
　・特許権侵害訴訟における第三者意見募集制度の導入
　・特許料等の見直し
　・弁理士制度の見直し

改正法の施行時期や制度の運用詳細は今度決まってきます。

特許法等の一部改正が先日閣議決定されました。ユーザーに特に関係が出てくるのは、
・海外からの模倣品流入への規制強化【意・商】
→個人使用だと商標権侵害にならない、という点を使った模倣品輸入に対応、海外事業者が模倣品を郵送等で国内に持ち込む行為を商標権等の侵害とできるようにした。
・特許料等の料金体系見直し
といった点でしょうか。このあと第204回通常国会に提出される予定です。

「特許法等の一部を改正する法律案」が閣議決定されました。現在開会中である、第204回通常国会に提出される予定です。

大ヒットの「鬼滅の刃」、漫画そのものは著作権で保護されるものですが、タイアップの商品やサービスにおいて「鬼滅の刃」との言葉を使う場面になると商品等のブランド名として「鬼滅の刃」を商標で守る必要があります。しかも、「鬼滅」だけを抜き出したものやそれらを匂わせたものからどう守るか等も含めていろいろと方策を考えていく必要があります。

新コロ感染症拡大により収入・売上が減少した方を対象に、 特許、実用新案、意匠の出願費用の一部を日本弁理士会が援助する制度が発表されました。

経済的な事情によって特許出願等の依頼が出来ない場合の援助制度です。

ギタリストのエディ・ヴァン・ヘイレンが亡くなりました。超絶テクニックのギタリストでしたが、米国において自ら開発に携わった楽器に関する特許を有していました（既に失効済み）。演奏する状態を表した図1に描かれたギタリストの絵が秀逸です。
米国特許商標庁(USPTO)がツイッターで追悼ツイートしていました。
