日本・中国・韓国における横断的な特許調査サービスを開始しました!!!

昨今、知的財産権の重要性が高まり、それに伴い、特許紛争も多くなってきています。販売していた商品やサービスが、突然に、第三者の特許権を侵害するものとして、その商品の製造・販売の差止が請求さることや、過去のその商品の売り上げに応じた損害賠償請求されることがあります。特許権の侵害が認められてしまうと、その商品・サービスを手掛けていた企業の立場からは、企業活動に対して相当な打撃となってしまいます。
特許権の権利行使を受けた場合に、その特許の有効性を争うことも、重要な防御策の１つです。特許無効審判などで、その特許が消滅することになれば、特許権の侵害が成立せずに終了するからです。
したがって、当該特許権の出願日前に、既に公知となっていたことを示す特許文献その他の文献を調査することは重要です。そして、通常の特許審査では、調査対象とされなかった外国の特許文献やその他の文献を調査する意義があります。問題となっている特許内容が、外国の文献では公知となっているケースも否定できないものです。

このような昨今の状況を鑑み、日本・中国・韓国の特許文献調査を基本とする、横断的な調査サービスを開始します。また、ご要望に応じて、いずれかの国のみでの調査もお受けいたします。
